How to Appeal a Council Tax Reduction Decision in Cheshire East

Start with a Reconsideration — Not a Tribunal

If Cheshire East Council has refused your Council Tax Support claim, calculated your award incorrectly, or rejected your backdating request, you have a legal right to challenge the decision. The process has two stages, and you must follow them in order.

Stage 1 is a written reconsideration to the council itself. Stage 2 — after the reconsideration — is an appeal to the Valuation Tribunal for England (VTE), an independent judicial body under Section 16 of the Local Government Finance Act 1992.

Most disputes are resolved at Stage 1. The council may have made a calculation error, applied the wrong income figure, or overlooked evidence you submitted. A clear, specific reconsideration request forces them to re-examine the file.

The One-Month Window

You have one calendar month from the date you receive your decision letter or revised Council Tax bill to ask for a reconsideration. If it is more than a month since the decision, the council's online form asks you to explain why you did not submit it earlier. If you received the notice on 15 March, aim to submit by 15 April.

Use the council's online benefit reconsideration form. Do not delay submitting it because you are still gathering documents; use the form to say when you will provide them. Keep a copy and note when you submitted it.

What to Include in Your Reconsideration

A vague "I disagree with the decision" won't get far. Your request needs to identify the specific error you believe was made. Common grounds include:

  • Income miscalculation — the council used the wrong earnings figure, counted disregarded income (PIP, DLA, Child Benefit), or included your Universal Credit Transitional Protection element
  • Capital assessment error — they counted assets that should be disregarded, or used an outdated bank balance
  • Non-dependant deduction wrongly applied — a deduction was taken for someone who doesn't actually live with you, or who should be exempt (you receive a qualifying disability benefit)
  • Backdating refusal — you provided good cause evidence that wasn't properly considered
  • Missing evidence — you submitted documents that don't appear to have been processed

Structure your request as: "My decision notice dated [date] states [what it says]. I believe this is incorrect because [specific reason]. I have attached [evidence] to support this."

The Council's Response

Cheshire East has two calendar months from receiving your reconsideration to review the decision and respond in writing. They can confirm the original decision, amend it in your favour, or revoke it entirely.

During this period, you must keep paying your council tax as billed. A reconsideration request does not suspend your payment obligation. If the decision is later changed in your favour, overpaid amounts are credited back to your account.

Escalating to the Valuation Tribunal for England

If the council confirms its decision, changes it but not enough, or simply doesn't respond within two months, you can appeal to the VTE.

You must lodge your VTE appeal within two months of the date on the council's reconsideration decision letter. If the council does not reply within two months of your request, you can appeal directly to the VTE without waiting for its reply.

The VTE is independent — it examines whether Cheshire East applied its own scheme rules correctly and acted within the law. Hearings are usually conducted in writing (on paper), though you can request an oral hearing. There's no fee to appeal.

The tribunal can overturn the council's decision, send it back for recalculation, or uphold it. If you win, the council must implement the tribunal's decision and adjust your bill accordingly.

Don't Let the Window Expire

If you submit more than a month after the decision, the council asks you to explain the delay. You can still submit the reconsideration form; submit it promptly even if you're still gathering evidence. You can supplement your case after submission.

The Cheshire East Council Tax Reduction Guide includes a decision notice verification worksheet showing exactly which figures to check, and a structured reconsideration framework to make sure your request addresses the right grounds.
