How to Challenge Your Council Tax Band in Cheshire East

Band Challenges Go to the VOA — Not Cheshire East Council

Challenging your council tax band is a completely separate process from applying for Council Tax Support. Your council tax band is set by the Valuation Office Agency (VOA), a national body — not by Cheshire East Council. The council just bills you based on whatever band the VOA assigns.

If you believe your property is in the wrong band, your challenge goes directly to the VOA. The process is free. You don't need to pay a claims company to do it for you, despite what some firms advertise.

When a Band Challenge Makes Sense

Council tax bands in England are based on what your property would have sold for on 1 April 1991. Not what it's worth now — what it would have been worth 35 years ago. The VOA estimates this using property records, sales data, and comparisons with similar homes.

A challenge is worth pursuing if:

  • Similar properties on your street are in a lower band — check the VOA's online council tax list to compare. If identical semi-detached houses are Band B but yours is Band C, there may be an error.
  • Your property has been structurally altered to reduce its value — demolishing an extension, converting from a house to flats, or losing significant floor space since the band was last set.
  • There's a factual error in the VOA's records — wrong property size, wrong number of rooms, wrong property type.

A challenge is less likely to succeed if your property is simply worth less than you think it should be, if local house prices have fallen (bands are fixed to 1991 values, not current values), or if you're comparing against properties in a different area with different 1991 valuations.

The Risk: Your Band Could Go Up

This is the critical warning that band-challenge companies sometimes downplay. When the VOA reviews your property, they can move it up as well as down. If they increase your band, the higher bill applies from the date the valuation list is changed.

Before challenging, check comparable properties carefully. If most similar homes in your area are in the same band as you, a challenge is risky.

How to Submit a Challenge

  1. Check your current band and compare with neighbours at the VOA's online council tax list
  2. If you find evidence of a discrepancy, contact the VOA through their online service or by phone
  3. Provide your evidence — comparable property bands, details of structural changes, factual corrections
  4. The VOA reviews your case and responds with a decision

You have a legal right to make a proposal if you have been paying Council Tax on the property for less than six months, if the VOA changed the band in the last six months, or if a qualifying change has affected the property. If none of these grounds applies, you can ask the VOA for a band review, but that is not a formal proposal.

Band Challenges and Council Tax Support

If you're receiving Council Tax Support and your band is reduced, your entire council tax bill drops. That means your net liability falls, and your support amount may decrease too — but your out-of-pocket payment should be lower overall.

If your property is currently in Band E or above and you successfully get it reduced to Band D or below, you also escape the Band D cap that Cheshire East applies to higher-banded properties. That cap forces the council to calculate your support as if you're in Band D, leaving you to pay the full difference. Dropping below Band D removes that extra cost entirely.
