Walsall Council Tax Reduction Overpayment Recovery

A letter from Walsall Council saying you have been overpaid Council Tax Reduction is alarming, especially when you are already on a tight budget. Before you panic, understand that CTR overpayments are not recovered the same way as benefit debts — and you have clear rights if the council has made the error.

How CTR Overpayments Happen

An overpayment occurs when you received more Council Tax Reduction than you were entitled to for a given period. The most common triggers in Walsall are:

  • A change of circumstances reported late — your income rose, a non-dependant moved in, or your savings crossed the £6,000 capital limit, and the council was not told within the 21-day reporting window
  • Universal Credit fluctuations — monthly UC earnings changes pushed you into a lower discount band retrospectively, but the council had already credited the higher band to your account
  • Administrative error — the council applied the wrong income band or overlooked information you had already provided

How Walsall Recovers Overpaid CTR

Council Tax Reduction is not a cash benefit. It is a discount applied directly to your council tax account. So when the council recalculates and finds you were awarded too much, the recovery method is straightforward: they issue a revised Council Tax Demand Notice adding the excess back onto your bill.

The overpayment amount is spread across your remaining monthly instalments for the current financial year. If the overpayment relates to a previous year, the council raises a separate demand for the outstanding balance.

There is no separate "overpayment invoice" — it all sits within your council tax account. This means the enforcement route for unpaid overpayments follows the same path as unpaid council tax: reminder, final notice, summons, liability order.

What to Do When You Receive the Notice

Read the revised demand notice carefully. Check:

  1. The dates — does the overpayment period match when your circumstances actually changed?
  2. The income band applied — compare the band on the notice against Walsall's published income brackets for your household type
  3. Your reported change date — if you reported the change within 21 days, the council should have adjusted from the correct date, not an earlier one

If the figures look wrong, you have the right to request a written Statement of Reasons from the council, which obligates them to show exactly how they calculated your entitlement and the overpayment.

If You Cannot Afford the Increased Payments

Contact Walsall Council immediately on 0300 555 2855 to discuss spreading the repayment over a longer period. You can also request that your annual instalments be spread across 12 months instead of the standard 10, reducing the monthly hit.

If the overpayment creates genuine hardship, you may be eligible for Section 13A Exceptional Hardship Support, which can reduce or write off the additional liability. Apply through the council's hardship portal at go.walsall.gov.uk/benefits/council-tax-reduction/apply-for-hardship-support.

Anyone facing council tax arrears they cannot manage should contact free debt advice services before things escalate: StepChange (0800 138 1111) or National Debtline (0808 808 4000).

Challenging the Decision

If you believe the overpayment was calculated incorrectly, write to [email protected] within one month setting out why. The council has two calendar months to respond. If it rejects your challenge, you can appeal to the Valuation Tribunal for England within two months of the decision letter. If it does not respond within two months, you can appeal after that period; the appeal guidance gives a four-month deadline from your original request. There is no fee for the appeal.

Our Walsall Council Tax Reduction guide walks through the full dispute process with timeline trackers and template frameworks for structuring your written challenge — useful when the numbers on a revised demand notice do not add up.
