Walsall Council Tax Reduction on Legacy Benefits and Housing Benefit

If you are still claiming Housing Benefit, income-based ESA, or income-based JSA in Walsall, you are on legacy benefits — and the way Council Tax Reduction interacts with your claim is different from the Universal Credit path most new claimants follow. If you receive a Migration Notice, follow the deadline and instructions in it so your legacy benefits do not stop before you claim UC.

Legacy Benefits and CTR in Walsall

Council Tax Reduction replaced Council Tax Benefit nationally in 2013. Under the old system, Housing Benefit and Council Tax Benefit were administered together by the local authority. Now they are separate: Housing Benefit covers rent, and CTR covers council tax. You need to claim each one independently.

If you are on income-based ESA, income-based JSA, or Income Support, Walsall's local CTR scheme still applies. Your income is assessed using the same income-banded grid as Universal Credit claimants. The difference is in how the council receives your income data:

  • Legacy benefits: the council assesses your income from the evidence you provide directly — payslips, benefit award letters, bank statements
  • Universal Credit: the DWP sends an automated data feed to the council, and your income bands are derived from the UC payment breakdown

In practice, legacy benefit claimants often have more stable CTR awards because their underlying benefits do not fluctuate monthly the way UC earnings do. A fixed ESA award puts you in a predictable income band with a consistent discount.

Housing Benefit Is Not Council Tax Reduction

This is the single most common confusion among legacy benefit claimants. Housing Benefit pays towards your rent. It does not reduce your council tax bill. They are separate claims, administered by separate teams within the council, even though both are "local authority benefits."

If you receive Housing Benefit and have not separately claimed Council Tax Reduction, you are paying your full council tax bill when you might be entitled to up to 75% off (or 100% if you are pension age).

Managed Migration to Universal Credit

When you receive a Migration Notice from the DWP, claim Universal Credit by the deadline stated in the notice or your legacy benefits may stop.

When you move to UC:

  1. Check your housing-cost arrangements — if Housing Benefit ends as part of your move to UC, check how eligible rent costs are handled in your UC claim and whether an exception applies
  2. Tell Walsall you want to claim CTR — selecting council tax support on your UC claim prompts the DWP to notify the council; confirm that Walsall has received your claim rather than assuming an existing CTR award transfers automatically
  3. Your CTR award may change — UC monthly assessment periods cause more frequent income fluctuations than legacy benefits, which can shift you between income bands month to month

The critical action at migration: make sure you tick the council tax support box on your UC claim. This prompts the DWP to notify Walsall Council and starts the local CTR claim process. Confirm with the council that it has received the notification; if you miss this step, there can be a gap where no CTR is applied and you receive a full council tax bill.

What to Do Before Migration

Before your migration notice arrives, check that your existing CTR claim is active and up to date. Report any changes within 21 days. When migration happens, contact Walsall Council on 0300 555 2855 to confirm it has received your UC council tax support notification and ask whether it needs more information.

If your monthly UC payments fluctuate because of variable earnings, expect your council tax bill to change more often than it did under legacy benefits. Walsall Council issues revised demand notices when your income band shifts, recalculating the remaining monthly instalments.

Our Walsall Council Tax Reduction guide explains how the UC data feed works with Walsall's income bands and what to watch for during the transition from legacy benefits — including how to request backdating if there is a gap in your CTR cover during migration.
