Stormwater and Domestic Waste Pensioner Concession in NSW

What the Statutory Concession Actually Covers

Under Section 575 of the Local Government Act 1993, the mandatory pensioner rebate applies to ordinary rates and domestic waste management (DWM) charges combined. Your council calculates 50% of the total levy for those two items, then caps the concession at $250 per year. Domestic waste charges are included in that calculation — they are not a separate rebate.

Stormwater charges are different. The statutory Section 575 concession does not cover stormwater levies, because stormwater management charges sit outside the ordinary-rates-and-DWM basket that the Act defines.

So How Do Pensioners Get Relief on Stormwater?

Through voluntary rebates under Section 582. Some councils choose to waive or reduce stormwater charges for pensioners, but they are not required to.

Penrith City Council, for example, provides a voluntary rebate covering the full stormwater management charge — $25 for a freestanding house, $12.50 for a strata unit. Inner West Council grants a 100% waiver on stormwater charges for eligible pensioners who have owned and occupied their property in the LGA for at least 10 years.

Other councils may not offer any stormwater relief at all. The only way to know is to check your council's Revenue Policy in its annual Operational Plan, or phone the rates department directly.

Domestic Waste: Already Inside the $250 Cap

Your domestic waste management charge — the annual charge for kerbside bin collection, recycling, and green waste — is always part of the statutory rebate calculation. When a council sends your rates notice showing a separate line for domestic waste, the rebate formula adds it to your ordinary rates before applying the 50% discount, up to the $250 cap.

In practice, because most NSW residential rates-plus-waste bills exceed $500, the 50% calculation almost always hits the cap. The effective rebate is $250 regardless of how high the waste charge climbs.

But some councils go further. Inner West Council offers a 100% voluntary domestic waste rebate for long-term pensioner residents, eliminating the qualifying charge entirely on top of the statutory $250 — a significant difference on a fixed income.

What About Stormwater in Sydney Water Areas?

If your council is within the Sydney Water service area, Sydney Water issues a separate stormwater charge on your quarterly water bill. The Sydney Water pensioner concession includes a stormwater rebate — currently $13.68 per quarter for a house, less for strata — applied automatically once you are registered as a pensioner with Sydney Water.

This is separate from anything your local council does. You can receive both the council's Section 575 rebate on rates and waste, and Sydney Water's stormwater concession on your water bill.

How to Claim

The statutory concession on rates and domestic waste comes through your council's pensioner application form — the same form you use for the ordinary rates rebate. There is no separate domestic waste application.

For stormwater relief, check whether your council offers a Section 582 voluntary waiver. If it does, it may be bundled into the pensioner application. If your council does not offer one, Sydney Water has a separate stormwater service-charge rebate in its service area; Hunter Water's pensioner scheme covers water and wastewater charges.

The NSW Pensioner Rates Rebate Claim Guide covers every concession layer — statutory, voluntary, and water utility — so you can confirm exactly which charges your council reduces and which require a separate utility application.
