How to Backdate Council Tax Reduction in Southwark: Good Cause Rules and Deadlines

How Far Back Can You Backdate?

Working-age applicants in Southwark can request backdating for up to six months before the date the council receives the backdating request. That's the hard ceiling — the council has no discretion to go further, no matter how compelling your circumstances.

Pension-age residents get a different deal: up to three months of automatic backdating without needing to prove anything. The claim is simply extended backward by default.

For working-age claimants, nothing is automatic. You need to submit a separate backdating request and demonstrate "good cause" for the entire period you're claiming.

What Counts as Good Cause?

Good cause is the legal test Southwark applies to decide whether your late claim was reasonable. You need to show a continuous, credible reason why you didn't apply sooner — and that reason must cover every week of the backdating period, not just the triggering event.

Reasons the council typically accepts include:

  • Serious illness or hospitalisation — you were physically or mentally unable to manage administrative tasks. A GP letter or hospital discharge summary strengthens this.
  • Bereavement — the death of a close family member disrupted your ability to handle finances and paperwork.
  • Official misdirection — a council officer, DWP adviser, or Jobcentre Plus worker gave you incorrect information (e.g., told you UC would cover your Council Tax), and you relied on it.
  • Domestic crisis — fleeing domestic abuse, sudden homelessness, or emergency relocation where managing a CTR claim was impossible.

General financial hardship alone does not explain why you could not apply. Set out what prevented you from applying and how it continued throughout the requested period, with supporting evidence where available.

The critical word is "continuous." If you're requesting four months of backdating, you need to explain why good cause applied in each of those four months. A hospital stay in month one doesn't automatically cover months two through four — you'd need to show ongoing recovery or follow-up complications that prevented you from applying.

How to Submit the Backdating Request

Southwark handles backdating requests through its online portal form (reference fm_fid=745). This is separate from the main CTR application — if you haven't already applied for CTR, you'll need to do both.

The form asks for:

  1. The period you want backdated (specific dates)
  2. Your written explanation of good cause
  3. Supporting evidence (medical letters, benefit correspondence, police reports, or whatever documents corroborate your reason)

Submit the online form fm_fid=745 through Southwark's forms portal. Keep a copy of your submission reference number.

What Happens After You Submit

The council reviews your request against the good cause criteria. If approved, the reduction is applied to your Council Tax account retrospectively. You'll receive a revised demand notice showing the adjusted balance, and if you've already paid instalments covering that period, the overpayment either reduces your remaining instalments or gets refunded to your bank account.

If the request is refused, you have the right to ask Southwark to reconsider. If they maintain the refusal, you can appeal to the Valuation Tribunal for England within two months of the council's response.

Building a Strong Backdating Case

The difference between an approved and a refused request often comes down to documentation. A vague statement like "I was unwell" carries far less weight than "I was admitted to King's College Hospital on 3 March and discharged on 18 March, followed by six weeks of outpatient recovery during which my GP advised against managing complex paperwork" — accompanied by the relevant letters.

Structure your explanation as a timeline: what happened, when, and why it prevented you from applying at each point in the backdate period. Attach dated evidence for each segment.

The Southwark Council Tax Reduction guide includes a backdating good cause timeline template that helps you map your circumstances against the six-month window and organise supporting evidence chronologically.
