Severe Mental Impairment Council Tax Exemption in West Northamptonshire

What the SMI Disregard and Exemption Are

Severe Mental Impairment (SMI) is a legal status under Council Tax legislation that removes a person from the Council Tax headcount. If you have a severe and permanent impairment of intelligence and social functioning — caused by conditions like dementia, Alzheimer's, severe learning disabilities, or brain injury — you can be "disregarded" for Council Tax discount purposes.

This is not discretionary. It is a statutory right under the Local Government Finance Act 1992, and West Northamptonshire Council must apply it once the qualifying conditions are met.

The practical effect depends on who else lives in the property:

  • SMI person living alone: full exemption from Council Tax (Class U exemption) — the bill drops to zero
  • SMI person living with one other non-disregarded adult: the other adult qualifies for the 25% Single Person Discount because the SMI person does not count
  • SMI person living with two or more non-disregarded adults: no discount from the disregard alone. The SMI disregard does not itself waive an LCTRS non-dependant deduction; WNC waives those deductions if the claimant or their partner receives the specified disability benefits.

The Two Requirements

To qualify for SMI disregard in West Northamptonshire, you must satisfy both conditions:

1. A GP certificate confirming severe mental impairment

Your registered GP must complete WNC's Council Tax Discount Application form, confirming that you have a severe impairment of intelligence and social functioning that appears to be permanent. This is a medical opinion, not a diagnosis — the GP certifies the functional impact, not the specific condition.

Some GPs are unfamiliar with this process and may be reluctant to complete the form. If your GP is unsure, point them to the Council Tax (Discount Disregards) Order 1992 and explain that it is a standard local authority form. You can also ask WNC to send the form directly to the GP surgery.

2. Entitlement to a qualifying benefit

The person must also be receiving at least one qualifying benefit under WNC's rules:

  • Personal Independence Payment (PIP) daily living component
  • Attendance Allowance
  • Disability Living Allowance (DLA) care component (middle or highest rate)
  • Employment and Support Allowance (ESA) — income-related or contribution-based
  • Incapacity Benefit (legacy)
  • Universal Credit with the Limited Capability for Work or Limited Capability for Work and Work-Related Activity (LCWRA) element
  • Severe Disablement Allowance (legacy)
  • Armed Forces Independence Payment

How to Apply in West Northamptonshire

  1. Request the WNC Council Tax Discount Application form from [email protected] or download it from the WNC website
  2. Take the form to the person's GP for completion and signature
  3. Gather proof of the qualifying benefit — a DWP award letter, PIP decision letter, or ESA notification
  4. Return the completed GP form and benefit proof to WNC

WNC does not charge for processing the application. If the qualifying conditions were met earlier, provide evidence of when both the impairment and qualifying benefit began and ask WNC to review the bill from that date.

Backdating and Refunds

If the person had SMI and a qualifying benefit before you applied, send dated medical and benefit evidence and ask WNC to review the earlier period. Do not assume a backdated Council Tax refund has no time limit; WNC will need to determine whether earlier bills can be amended.

Many families do not learn about SMI disregard until years after a dementia diagnosis. If this applies to your household, applying now and asking WNC to review the earlier period could result in a refund if the council approves the request.

How SMI Interacts with Council Tax Reduction

If the SMI-disregarded person was previously counted in the household for LCTRS purposes, their removal can change the award calculation. It can also trigger the Single Person Discount if only one non-disregarded adult remains.

For maximum benefit, apply for the SMI disregard first, let WNC adjust the bill, and then ensure the Council Tax Reduction claim is recalculated against the new lower net liability. If you already receive CTR, notify WNC of the SMI disregard as a change of circumstances — the recalculation should happen automatically, but it is worth confirming.
