How to Claim the SMI Council Tax Exemption in England

Before You Start: Two Things You Need

The SMI council tax claim requires two pieces of evidence. Without both, the council cannot process it.

1. A qualifying benefit award letter. This is a letter from the DWP confirming the person receives Attendance Allowance, PIP Daily Living Component, DLA Care Component (middle or highest rate), UC with an LCW or LCWRA element, main-phase ESA with a support or work-related activity component, or one of the other qualifying benefits. The letter must show the benefit name, rate, and start date.

2. A completed SMI medical certificate. A registered medical practitioner must certify that the person has "a severe impairment of intelligence and social functioning which appears to be permanent" and state the onset date. This is usually completed by the person's GP.

If the person lacks capacity to manage their own affairs, whoever is acting on their behalf — under a Lasting Power of Attorney (Property and Financial Affairs), a Court of Protection Deputyship, or a DWP Appointeeship — can submit the claim and sign the application.

Step-by-Step Claim Process

Step 1: Get the council's application form. Each billing authority in England has its own SMI form — there is no single national form. Search your council's website for "severe mental impairment" or "council tax exemption for disabled person." Some councils offer online submission; others require a downloadable PDF form sent by post.

Step 2: Take the medical certificate to the GP. The form typically includes a doctor's certificate section. Book an appointment or drop the form at the GP surgery with a cover note. Bring or attach any supporting clinical documents: the dementia diagnosis letter, memory clinic reports, or cognitive assessment results. These help the GP certify a specific onset date.

The GP must complete this certificate free of charge. It is a mandatory NHS service under the GMS Contracts Regulations. If the surgery asks for payment, cite this regulation — we cover exactly how to handle that in our GP certificate preparation guide.

Step 3: Gather the benefit proof. Locate the most recent DWP award letter. If you cannot find it, you can request a replacement from the relevant benefit helpline or, for UC, download a UC statement from the online journal showing the relevant LCW or LCWRA entitlement.

Step 4: Complete the application form. You will need the council tax account reference number (on the annual bill or demand notice), the address, the qualifying person's details, and the details of every other adult resident in the household — because the discount amount depends on the headcount of remaining adults.

Step 5: Submit and keep records. Send the completed form, the signed GP certificate, and a copy of the benefit award letter to the council. If submitting by post, use recorded delivery. If submitting online, save the confirmation reference. Note the date you submit — this matters if the council delays its response.

Backdating Your Claim

If the person has been qualifying for months or years without claiming, include a covering letter requesting the discount from the earliest date when both the medical certification onset date and the qualifying benefit start date were in place. Council tax liability is calculated on a daily basis under the LGFA 1992, and primary legislation sets no time limit on how far back the discount can go.

The effective start date is the latest of three dates: when the person took up residence at the property, when the GP certifies the impairment began, and when the qualifying benefit was first awarded. Ask the GP to certify as far back as the clinical evidence supports.

What Happens After Submission

The council verifies the medical certificate and checks the qualifying benefit with the DWP. Processing times vary — some councils take two to three weeks, others six to eight. During processing, continue paying the existing council tax bill. Any overpayment is refunded or credited once the claim is approved.

Once approved, the council issues a revised demand notice showing the reduced (or zero) liability. If backdating was granted, revised notices cover each affected financial year and the resulting credit is refunded to the account holder.

If the Council Refuses

A refusal is not the end. You have a statutory right under Section 16 of the LGFA 1992 to submit a formal written grievance to the council. If the council rejects that or does not respond within two months, you can appeal to the Valuation Tribunal for England — a free, independent tribunal.
