How to Appeal Council Tax Reduction in Newham

You have received your Council Tax Reduction decision from Newham Council and the numbers look wrong. Maybe the income figure does not match your payslips, a non-dependant deduction has been applied at the wrong band, or the council has refused to backdate your claim when you believe you had good cause. Whatever the reason, there is a formal route to challenge the decision — and it does not cost anything.

The process has three stages, and you must work through them in order.

Stage 1: Informal Query

Before launching a formal dispute, contact the Council Tax and Benefits Service on 020 8430 2000 or through the online contact form. Ask for a breakdown of the calculation and point out the specific figure you think is wrong.

This is not a formal step — it does not pause any deadlines or create a legal record. But it resolves a surprising number of disputes. Sometimes the council has used an outdated payslip or missed a disability premium. An informal call can fix that faster than a written process.

If the issue is not resolved, move to Stage 2.

Stage 2: Formal Section 16 Grievance

Under Section 16 of the Local Government Finance Act 1992, you have the right to submit a written grievance about your CTR decision. This is the mandatory internal review — you cannot skip it and go straight to the tribunal.

Your grievance must:

  • Be in writing (letter or email to the council)
  • Name the specific decision you are challenging
  • Set out the grounds — which figure is wrong, what the correct figure should be, and why

Send it to:

Council Tax and Benefits Service Newham Dockside, 1000 Dockside Road, London E16 2QU

Common grounds include:

  • Income miscalculation — the council used gross income instead of net, or failed to apply the correct earnings disregard (£5 single, £10 couple, £25 lone parent)
  • Non-dependant deduction error — a non-dependant has been placed in the wrong income band, or a deduction has been applied for someone who is exempt (for example, a non-dependant on Income Support should attract a nil deduction)
  • Missing disability premium — a qualifying benefit like PIP or DLA was not reflected in the Applicable Amount
  • Backdating refusal — you believe you had continuous good cause (illness, hospitalisation, misdirection by an official body) for the period claimed

Newham Council has two calendar months from receipt to issue a formal written response.

Stage 3: Appeal to the Valuation Tribunal for England

If Newham rejects your grievance, or does not respond within two months, you can appeal to the Valuation Tribunal for England (VTE).

Deadlines:

  • Within 2 months of receiving the council's grievance decision, or
  • Within 4 months of submitting your Section 16 grievance if the council never responded

What the VTE can review:

  • Calculation errors (income, capital, applicable amounts, non-dependant deductions)
  • Eligibility decisions
  • Backdating decisions
  • Discretionary Section 13A(1)(c) decisions

What the VTE cannot do:

  • Change the lawful terms of Newham's adopted scheme — the 70% working-age cap, the 30% taper rate, and the £6,000 capital limit are policy decisions the VTE cannot override

Cost: Free. Neither party can be awarded costs against the other.

You can submit your appeal online at the VTE website. The tribunal is independent of Newham Council and operates as a judicial body. Hearings can be conducted in person, by phone, or on paper.

Practical Tips

Keep a paper trail from the start. Every phone call should be followed by a brief email or letter confirming what was discussed. If the council asks for evidence by phone, send it in writing and note the date. This log becomes your evidence if the dispute reaches the tribunal.

If the figures on your decision notice look confusing, our Newham Council Tax Reduction guide includes a decision-notice audit worksheet that walks through each line — the Applicable Amount, the income taper calculation, the non-dependant deductions, and the 70% cap — so you can identify exactly where the error sits before writing your grievance.

For help drafting the letter, Citizens Advice Newham offers free support. If the dispute involves enforcement or arrears, contact StepChange (0800 138 1111) or National Debtline (0808 808 4000) first — they handle the debt side while you deal with the CTR dispute.
