Legacy Benefits and Rate Rebate in Northern Ireland
If you're still on Income Support, income-related Employment and Support Allowance, or income-based Jobseeker's Allowance in Northern Ireland, your rates help comes through a completely different route than someone on Universal Credit — and the transition between the two is where people lose money.
Legacy Benefits Mean NIHE, Not LPS
Working-age claimants on legacy benefits apply for Housing Benefit for rates through the Northern Ireland Housing Executive (NIHE), not through the LPS Rate Rebate online portal. The NIHE handles your rates claim alongside any rent support through Housing Benefit.
If you're on a passporting benefit — Income Support, income-related ESA, or income-based JSA — you qualify for maximum Housing Benefit for rates automatically, without a separate means test on your income. The NIHE takes your benefit status as proof of low income and awards the full amount.
The capital limit for working-age legacy claims is £16,000. Above that, you're disqualified. Capital between £6,000 and £16,000 attracts tariff income of £1 per week for every £250 (or part of £250) above £6,000.
The UC Migration Trap
Here's where the real risk sits. When you're moved from a legacy benefit to Universal Credit — whether through managed migration or because a change of circumstances triggers a new claim — your NIHE Housing Benefit for rates stops.
UC doesn't cover rates. The housing element of Universal Credit pays eligible rent costs only. Domestic rates in Northern Ireland are explicitly excluded. So the moment your legacy benefit ends and UC begins, you have zero rates support unless you take a separate action.
That separate action is applying for Rate Rebate through Land & Property Services (LPS) via the nidirect online portal. This is a completely different system, run by a different government body, using a different application process. Nobody sends you a form. Nobody tells you automatically. The responsibility sits entirely with you.
Between the legacy benefit ending and the Rate Rebate being processed, you're liable for the full rates bill. If you apply more than three calendar months after your UC award notice, LPS backdating is capped at three months before your Rate Rebate application date, so earlier entitlement can be lost.
What "Protected" Legacy Claims Look Like
Not everyone on legacy benefits has been migrated yet. Some working-age claimants remain on NIHE Housing Benefit in protected categories:
- Tenants in specified supported accommodation or temporary shelter
- Households on passporting legacy benefits where UC hasn't been triggered by a change of circumstances
If you're in one of these groups, your NIHE Housing Benefit continues while you remain eligible. Report relevant changes to NIHE promptly; a change may affect your entitlement or the scheme you need.
Report relevant changes to NIHE as required. If you're unsure how a change may affect your Housing Benefit or claim route, Advice NI (0800 915 4604) or Housing Rights (028 9024 5640) can explain your options.

How to Protect Yourself During the Switch
If migration does happen, act within the first week:
- Note the exact start date of your UC award from your online journal
- Create an account on nidirect and apply for Rate Rebate immediately
- Continue paying your rates bill on the existing schedule while the application is processed
- Keep copies of your legacy benefit end date and UC start date — you'll need both for backdating
The three-month window for full backdating runs from your UC award notice. If you apply later, backdating is capped at three months before your application date, so earlier entitlement can be lost.
Our Rate Relief and Housing Benefit for Rates guide covers the full migration sequence, including the evidence LPS needs, how the means test works differently under Rate Rebate versus Housing Benefit, and what to do if your Rate Rebate award comes back lower than your old Housing Benefit was.
