Kirklees Council Tax: Severe Mental Impairment and Disabled Band Reduction

Two statutory council tax reliefs in Kirklees are specifically designed for disabled residents, and both are underused. The Severe Mental Impairment disregard can eliminate your bill entirely. The Disabled Band Reduction drops your charge to the next lower band. Neither is part of the means-tested Council Tax Reduction scheme — they're applied before CTR is even calculated, which means they stack.

Severe Mental Impairment (SMI) Disregard

A person who is severely mentally impaired is disregarded for Council Tax purposes. They're treated as if they don't live in the property. The impact depends on who else lives there:

If the SMI person lives alone, the property becomes exempt from Council Tax entirely. The bill drops to zero.

If the SMI person lives with one other adult (who isn't also SMI-disregarded), that other adult becomes the sole countable resident. They qualify for the 25% Single Person Discount. If they're on a low income, they can then claim Council Tax Reduction on the discounted amount.

If two people with SMI live together and no other adults are present, the property is fully exempt.

Who Qualifies for SMI

Two conditions must both be met:

  1. Medical certification: A registered medical practitioner (usually the person's GP) must certify that the individual has a severe impairment of intelligence and social functioning that appears to be permanent. This covers conditions like dementia, severe learning disabilities, severe brain injuries, and other conditions causing permanent cognitive impairment.

  2. Qualifying benefit: The person must be entitled to a qualifying benefit (not necessarily receiving it), such as Attendance Allowance, Disability Living Allowance (middle or highest rate care component), Personal Independence Payment (Daily Living component), Incapacity Benefit, Employment and Support Allowance, Severe Disablement Allowance, the disability element of Working Tax Credit, Universal Credit with a qualifying limited-capability element, or Armed Forces Independence Payment.

Kirklees requires medical certification and proof that the person is entitled to a qualifying benefit; follow the Council Tax discount form's instructions for what to submit.

Disabled Band Reduction

If a property has been adapted or has features essential for a disabled resident's needs, it may qualify for a Disabled Band Reduction. The property is charged at the rate of the next lower valuation band.

A Band D property would be charged at the Band C rate. A Band A property gets a special reduced rate below Band A. This applies regardless of income — it's a property-based relief, not a means test.

The property must have at least one of:

  • A room (not a bathroom, kitchen, or toilet) used predominantly by the disabled person and essential to their needs
  • An additional bathroom or kitchen required for the disabled person's use
  • Sufficient floor space for the disabled person to use a wheelchair indoors

The disabled person doesn't need to be the Council Tax payer — they just need to live in the property as their main home. Apply to Kirklees Council with evidence of the adaptation or feature and confirmation of the disability.

How These Stack with Council Tax Reduction

Both the SMI disregard and the Disabled Band Reduction are applied to the bill before Council Tax Reduction is calculated. This creates a compounding effect:

  1. Disabled Band Reduction lowers the band charge (say, Band D to Band C)
  2. Single Person Discount (if applicable) reduces the bill by 25%
  3. The remaining amount is the starting point for CTR, which covers up to 75% of it

For a disabled person living with an SMI-certified partner in a Band C property, the bill could be reduced to the Band B rate, then the Single Person Discount applied (because the SMI partner is disregarded), and then CTR calculated on the remainder.

These reliefs are separate from PIP, DLA, and other disability benefits — receiving those benefits doesn't automatically trigger the band reduction or SMI disregard. You need to apply for each one separately.

The Kirklees Council Tax Reduction guide covers all three layers — statutory disability reliefs, discounts, and means-tested CTR — and how they combine.
