How to Appeal a Council Tax Reduction Decision in Hillingdon

Stage 1: Internal Review via Form 147

If you disagree with Hillingdon Council's decision on your Council Tax Reduction — whether they refused your claim, assigned the wrong income band or miscalculated your non-dependant deductions — the first step is a formal internal review.

Hillingdon uses Form 147 for revision requests. Submit your request in writing within one month of the decision date. Explain what you believe the council got wrong, specifying:

  • Which part of the decision you're challenging (income band, capital assessment, non-dependant deduction, backdating refusal)
  • Why you believe the calculation or decision is incorrect
  • What evidence supports your position

Send the completed form or a written request to [email protected]. You can also post it to the benefits department, but email gives you a timestamped record.

Hillingdon aims to complete reviews within 30 days; the council must respond in writing within two calendar months. The review is usually carried out by a different officer, who re-examines the evidence, recalculates the award and either upholds the original decision, amends it in your favour or explains why it stands.

What to Challenge

The most productive grounds for internal review tend to be:

Income band miscalculation: The council placed you in the wrong band because it didn't apply the £25 earnings disregard, counted income that should have been excluded (certain UC elements, disability benefits), or used the wrong household category on the grid.

Non-dependant deduction errors: The council applied a £12/week deduction for someone who should be exempt — full-time students and people receiving State Pension Credit don't trigger the deduction.

Capital assessment mistakes: The council included assets that should be disregarded (personal possessions, the value of your home, business assets for active self-employment) in the £6,000 capital calculation.

Backdating refusal: You provided good cause evidence that the council dismissed without adequate explanation.

Stage 2: Valuation Tribunal for England (VTE)

If Hillingdon upholds its decision after the internal review — or fails to respond within two months — you can escalate to the Valuation Tribunal for England (VTE). This is a fully independent judicial body with statutory authority under Section 16 of the Local Government Finance Act 1992.

Key facts about the VTE appeal:

  • Filing deadline: two months from the date you receive the council's internal review response. If the council never responded, you can file any time after the initial two-month review window expires.
  • Cost: completely free. No court fees, no charges.
  • Representation: you don't need a solicitor. You can submit written representations or attend a hearing (in person or digitally).
  • Powers: the VTE can alter the council's decision if it finds the council misapplied its own adopted scheme or relevant statutory regulations.

Submit your appeal through the VTE website (valuationtribunal.gov.uk). Include all evidence you submitted to the council, plus any new documentation that supports your case.

You Must Keep Paying During the Appeal

Filing a review or VTE appeal does not suspend your obligation to pay council tax. You must continue paying the instalments shown on your current demand notice throughout the process. If your appeal succeeds and the council overpaid, the excess is credited to your account or refunded.

Not paying while you wait for an appeal outcome can trigger enforcement action — summons, liability orders, bailiff referrals — regardless of the pending dispute.

Building Your Case

For each ground of challenge, map the specific scheme rule the council violated against the evidence in your possession:

  • Cite the income band thresholds from the 2026/27 scheme and show where your income actually falls
  • Attach the payslips, UC statements or bank statements that demonstrate the correct figure
  • If challenging a non-dependant deduction, provide the non-dependant's student confirmation letter or State Pension Credit award notice
  • For backdating, present a clear chronology showing continuous good cause with dated supporting evidence

The strongest appeals are factual and specific — "my weekly income after the £25 disregard is £88, which falls in Band 3 (up to £90), not Band 4 as assessed" rather than general complaints about the amount.
