Enfield Council Tax Reduction Overpayment: What Happens and What to Do

An excess Council Tax Support adjustment from Enfield can be alarming. The council may cancel an excess reduction and recalculate your liability for the relevant period, leaving an additional balance on your Council Tax account.

Why Overpayments Happen

Council Tax Support overpayments in Enfield usually trace back to one of three causes:

Delayed change reporting. Enfield requires changes to be reported within 21 days. If a change reduces or ends your award, the council can cancel the excess reduction and recalculate your Council Tax liability for the relevant period.

A change reported only to DWP. Updating your Universal Credit journal does not satisfy the separate duty to notify Enfield Council. Report the change to Enfield as well.

Reassessment of capital. Capital above £16,000 can make a working-age household ineligible. If a reassessment changes entitlement for an earlier period, Enfield recalculates the Council Tax liability for that period.

Your Rights When You Get an Overpayment Notice

Enfield's written decision notice sets out the assessed income, household composition, capital, award, entitlement period, and dispute rights.

Excess Council Tax Support is not recovered as a civil debt or benefit deduction. Enfield cancels the excess reduction, recalculates your Council Tax liability, and issues a revised demand notice. Any balance is then due on the Council Tax account under the revised instalment schedule.

You can request a detailed written breakdown of the overpayment calculation. This is worth doing — mistakes happen. Common errors include the council using the wrong earnings figure, applying the wrong UC income band, or miscalculating the period the overpayment covers.

Challenging an Overpayment

If you believe the overpayment is wrong — the figures don't match your records, or you reported the change on time — you can:

  1. Check the figures against your payslips, UC assessment statements, bank records, and dates of any changes.
  2. Submit a written dispute to Enfield's Revenues and Benefits Service within one month of the decision notice. A phone inquiry does not stop this deadline.
  3. Appeal to the Valuation Tribunal for England if you remain dissatisfied with the council's review decision, or if the council does not respond within two months. The appeal deadline is two calendar months from the review decision or the end of the response period.

Keep any portal confirmation, email timestamp, or letter receipt. These records help you check whether the revised calculation used the right dates and figures.

If You Can't Afford to Repay

An overpayment added to your Council Tax bill can push your monthly payments to an unmanageable level. You have options:

  • Request a payment arrangement — Enfield can spread the overpayment over a longer period to keep instalments affordable
  • Ask about hardship relief — the Council Tax Support Hardship fund requires an active CTS award in payment and a shortfall for each day relief is requested; it does not automatically cover every revised balance
  • Get free debt advice — if you're struggling with multiple debts, StepChange (0800 138 1111), National Debtline (0808 808 4000) or Citizens Advice Enfield can help you prioritise which debts to deal with first; council tax arrears are a priority debt

Do not ignore the overpayment. Unlike some debts, council tax is a priority debt — the council has strong enforcement powers and can escalate to a liability order through the magistrates' court.

Preventing Future Overpayments

Report changes to Enfield in writing or through its online portal within 21 days. Keep a log of what you reported and when — a screenshot of the submission confirmation, the date and time you uploaded documents. If a dispute arises later, that log helps you check the revised calculation.

Our Enfield Council Tax Reduction guide includes a change-reporting log and Agency Communication Log — printable tracking sheets designed to document every change you report, so you have a clear paper trail if an excess CTS adjustment ever arrives.
