Dudley Council Tax Severe Mental Impairment Exemption — Who Qualifies and How to Claim

A severe mental impairment (SMI) exemption can reduce your council tax bill to zero — or, if you live with someone who is not also disregarded, qualify you for the 25% single person discount even in a two-adult household. It is one of the most valuable council tax reliefs available, and one of the most under-claimed.

In Dudley, as across England, someone with a severe mental impairment is completely disregarded for council tax purposes. That means the council treats the property as if they do not live there.

What Counts as Severe Mental Impairment

The legal definition is a severe impairment of intelligence and social functioning that appears to be permanent. It is not limited to dementia — the following conditions commonly qualify:

  • Alzheimer's disease and other forms of dementia
  • Severe learning disability
  • Stroke with lasting cognitive damage
  • Parkinson's disease (advanced stages)
  • Traumatic brain injury
  • Bipolar disorder or schizophrenia (where cognitive function is permanently affected)

Two things must be in place. First, a registered medical practitioner (GP or consultant) must certify in writing that the person has a severe mental impairment. Second, the person must be entitled to at least one qualifying benefit — for example, Attendance Allowance, the daily living component of PIP, the middle or higher rate of DLA care component, the support component of Employment and Support Allowance, Incapacity Benefit, or Universal Credit with a limited capability for work element.

How the Exemption Works in Practice

The SMI disregard removes the person from the council tax headcount entirely:

  • Person with SMI living alone: The property becomes exempt under Class U — no council tax to pay at all.
  • Person with SMI living with one other adult: The other adult qualifies for the 25% single person discount, because the person with SMI is disregarded from the count.
  • Two people with SMI living together: The property is fully exempt (both are disregarded).
  • Person with SMI living with two or more other adults: The SMI disregard alone may not reduce the bill. It does not itself waive Dudley's working-age CTR non-dependant deduction; that waiver applies when the CTR claimant or their partner receives PIP Daily Living or DLA Care Component.

This is separate from, and stackable with, Dudley's Council Tax Reduction scheme. If you're on a low income and caring for someone with an SMI, you could qualify for both the SMI disregard (reducing the base bill) and CTR (reducing what remains).

How to Claim in Dudley

Apply through Dudley's Council Tax Discounts and Exemptions route or contact Dudley Council Plus on 0300 555 2345. You will need:

  1. A medical certificate from the person's GP or specialist confirming the severe mental impairment — ask the surgery specifically for an "SMI certificate for council tax purposes"
  2. Proof that the person receives a qualifying benefit (an award letter from DWP showing PIP, Attendance Allowance, ESA, or the relevant UC element)

When you apply, include when the medical condition was certified as permanent and when the qualifying benefit entitlement began. Ask Dudley to confirm the effective date; do not assume the date of diagnosis alone determines backdating.

Common Reasons Claims Get Missed

Families often do not realise the SMI exemption exists because it is not part of the normal council tax billing process. The council does not automatically apply it when someone is diagnosed. You have to claim it.

Carers who manage a relative's finances sometimes assume the person is already getting every available benefit. But council tax discounts are administered by Dudley Council, not the DWP — so having all the right benefits in place does not trigger the SMI exemption until someone applies for it locally.

If you're helping a family member in Dudley navigate council tax while dealing with a qualifying condition, the Dudley Council Tax Reduction guide covers the broader landscape of reductions, including how the SMI disregard interacts with the working-age CTR scheme.
