Council Tax Reduction Scotland Backdating: How Far Back Can You Claim?

Two Completely Different Rules

Scotland's backdating rules depend entirely on whether you're assessed under working-age or pension-age regulations. The gap between them is significant — and getting it wrong means lost money you can't recover.

Pension age: automatic backdating of up to three calendar months, no questions asked.

Working age: backdating limited to one calendar month, and only if you can prove "good cause" for the delay.

Pension-Age Backdating

If both you and your partner (if you have one) have reached State Pension age and you're assessed under SSI 2012/319, you benefit from automatic backdating.

When you apply for CTR, the council must backdate your award up to three months before the date they received your application — provided you met the eligibility criteria throughout that period. You don't need to explain why you didn't apply earlier. You don't need to write a letter. The backdating is automatic.

Example: you apply on 15 October 2026. The council will backdate your CTR to 15 July 2026 (three months earlier) as long as you were eligible the whole time. If you were paying full council tax during those three months, you'll receive credit for the overpayment.

Working-Age Backdating

Working-age claimants under SSI 2021/249 face a stricter rule. You can ask for backdating of up to one calendar month before your application date, but you must make an explicit written request and demonstrate "good cause" for the entire backdated period.

Valid good cause reasons include:

  • Severe physical or mental illness, hospitalisation, or incapacity
  • Recent bereavement of a close family member
  • Incorrect advice from council officers or the DWP
  • Severe disruption to communications beyond your control

Things that do not legally constitute good cause include:

  • Not knowing about CTR or assuming it did not apply to you
  • Assuming the DWP automatically applied for CTR when you claimed Universal Credit

The council decides good cause applications on a case-by-case basis. If they refuse, you can challenge through the review and appeal process.

The Disability Benefit Backdating Rule

A special rule applies when you receive a retroactive award of a qualifying disability or carer benefit — Adult Disability Payment (ADP), Child Disability Payment (CDP), Pension Age Disability Payment (PADP), or Carer Support Payment (CSP).

If you submit your CTR application within 13 weeks of the decision awarding the benefit, the council must backdate your CTR to the effective start date of that benefit award. This can result in backdating well beyond the standard one-month or three-month limits.

This matters most when a disability benefit takes months to process. If ADP is awarded from six months ago, and you apply for CTR within 13 weeks of the ADP decision, your CTR also starts six months ago.

How Standard Start Dates Work

Without any backdating, working-age CTR starts on the Monday after the council receives your completed application. If you make contact first (by phone, online enquiry, or letter) and then submit the full form within one calendar month, the claim date can relate back to that initial contact.

This advance notification rule is separate from backdating. It protects your start date when there's a gap between first contact and submitting a complete application.

Protecting Every Day of Entitlement

Every week of CTR you miss is money gone — particularly for working-age claimants who can only backdate one month under restrictive conditions.

Our Council Tax Reduction in Scotland guide covers backdating in full detail, including how to structure a good cause request that gives you the strongest chance of approval, the 13-week disability benefit link, and how to protect your claim date from the first moment of contact with the council.
