Council Tax Single Person Discount When Partner Works Away

The sole or main residence test

The single person discount is not about how often someone sleeps in the property. It turns on whether the absent partner's "sole or main residence" remains at the family home. Under Section 6(5) of the Local Government Finance Act 1992, a resident is anyone aged 18 or over whose sole or main residence is in the dwelling.

Case law — including Williams v Horsham District Council and Lone v Hounslow London Borough Council — established that sole or main residence is decided by looking at the whole picture: where someone's family lives, where their financial ties sit, whether they intend to return, and where the centre of their domestic life is. No single factor is decisive.

A partner who works away Monday to Friday but comes home every weekend almost certainly keeps their main residence at the family home. The same applies to someone posted abroad for a year if the family home remains their permanent base.

Armed forces personnel posted away

Armed-forces personnel living in service family accommodation or barracks retain their main residence based on where their domestic ties are. If a service member is deployed overseas while their family stays in England, the family home remains their main residence unless they establish a sole or main residence elsewhere.

The exception is a service member who gives up the family home entirely and has no intention of returning. That is rare when a partner and children remain in the property.

Merchant seafarers and offshore workers

Merchant seamen and offshore oil and gas workers spend long stretches away from home. The same sole or main residence test applies. If the family home is where they return between voyages, where their partner and children live, and where their financial and administrative life is centred, it remains their main residence. The 25% discount does not apply.

If a seafarer is genuinely single and their shore address is just a registered address they never occupy — renting a room they rarely visit while spending 300+ days at sea — they may not be a resident there at all, which is a different question. A property with no resident does not qualify for the single person discount.

When the discount does apply

The discount applies when the absent partner has genuinely moved their main residence elsewhere. Examples:

  • A partner takes a permanent job in another city, signs a lease, moves their belongings and does not plan to return — even if they visit on weekends
  • A separated couple where the departing partner establishes a new home, even before divorce proceedings
  • A partner who emigrates and the remaining adult is now the sole resident

The key is permanence and intention. A temporary work placement or secondment, with a return date and the family home kept, does not shift main residence.

How to challenge a council's refusal

If you believe your partner's main residence has genuinely moved and the council disagrees, you can serve a Section 16 grievance setting out your evidence: the partner's new tenancy or mortgage, their electoral registration at the new address, utility bills, bank correspondence and any employment contract showing a permanent relocation.

The council has two months to respond. If it refuses or does not reply, you can appeal free to the Valuation Tribunal for England within two months of the decision (or four months from your original grievance if the council stays silent).

The England Single Person Discount guide covers the sole or main residence test in detail, with an evidence assembly checklist and a Section 16 grievance template.
