Birmingham Council Tax Reduction Backdating: The Good Cause Rule
Working-Age: One Month, With Good Cause
If you're working age and applied for Council Tax Support later than you should have, Birmingham can backdate your claim by a maximum of one calendar month before it receives your written request — but only if you can demonstrate continuous "good cause" throughout the requested period.
Good cause isn't defined in a neat list. It's a judgment the council makes based on your circumstances. Examples that may support a request, if they prevented you from applying throughout the requested period, include:
- Severe illness, sudden incapacity, or emergency hospital admission
- An unforeseen household crisis, domestic emergency, or immediate family bereavement
- Incorrect or misleading advice from an official body (for example, being told that UC covered council tax)
- Language, literacy, or serious communication barriers when support was unavailable
"I didn't know I had to apply separately" is trickier. Some councils accept it, particularly for new Universal Credit claimants who reasonably believed UC would handle council tax. Birmingham's acceptance depends on your individual circumstances and how you present the request.
Pension-Age: Up to Three Months, Automatic
Pension-age applicants are automatically backdated by up to three calendar months — no good cause argument is needed.
How to Request Backdating
When you submit your CTS application through the Citizen Access Portal, there's a section asking whether you want the claim backdated. If you're applying by post, include a cover letter with your backdating request.
Your request should include:
- The specific dates you want covered (up to one calendar month before the council receives the written request for working-age applicants)
- What prevented you from applying sooner — be specific and factual
- Any evidence supporting your explanation: hospital discharge letter, GP note, UC award letter showing the date you started UC, written advice you received from another agency
Keep the tone factual, not emotional. The assessor is looking for a clear reason tied to a clear timeline.

What Happens If Backdating Is Refused
If Birmingham refuses your backdating request, they must send you a written decision with their reasons. You have the right to:
- Request a written statement of reasons — the council must explain which elements of your case they considered
- Submit a grievance — a formal reconsideration by the council
- Appeal to the Valuation Tribunal for England — if the council maintains its decision, appeal within two calendar months of the decision notice; if it does not respond within two months, appeal within four calendar months of submitting your grievance. This appeal is free
For a decision notice, the two-month appeal deadline runs from its date. If the council does not respond, the four-month deadline runs from the date you submitted your grievance.
The Timing Trap
The one-month limit creates a common trap: someone starts Universal Credit, assumes it covers council tax, and only discovers it doesn't when they receive an arrears letter three or four months later. By then, they can only recover one month at most through backdating — the rest of the gap is owed in full.
The practical lesson: apply for Council Tax Support the same week you apply for Universal Credit, even if you haven't gathered all your documents yet. Establishing the claim date is what matters. Evidence can follow.
