Attendance Allowance, PIP, and DLA Council Tax Discount

How Disability Benefits Connect to Council Tax Relief

Receiving a disability benefit does not automatically reduce a council tax bill. But certain benefits serve as one half of the eligibility test for the severe mental impairment (SMI) council tax discount — a relief that can cut a bill by 25%, 50%, or eliminate it entirely depending on household composition.

The two-part statutory test requires: (1) a medical certificate confirming a severe impairment of intelligence and social functioning that appears to be permanent, and (2) entitlement to a qualifying benefit. This post covers which disability benefits satisfy the second limb and what to watch for with each.

Attendance Allowance

Attendance Allowance is the most common qualifying benefit for older applicants, particularly those with dementia. It is paid at two rates — a lower rate (£76.70/week in 2026/27) and a higher rate (£114.60/week). Either rate satisfies the SMI qualifying benefit test.

There is no lower threshold to worry about here. If the person receives Attendance Allowance at any rate, the benefit condition is met.

One thing to know: Attendance Allowance is suspended when someone has been in hospital for more than 28 days. The payment stops, but statutory entitlement continues. The SMI disregard remains in force during a hospital suspension because the test looks at entitlement, not receipt.

Personal Independence Payment (PIP)

PIP has two components: daily living and mobility. Only the daily living component counts as a qualifying benefit for SMI purposes. The mobility component, even at the enhanced rate, does not qualify on its own.

Both the standard rate (£76.70/week) and enhanced rate (£114.60/week) of PIP daily living satisfy the test. If the person receives PIP daily living at any level, the benefit condition is met.

PIP is the most common qualifying benefit for working-age applicants with conditions such as severe learning disabilities, acquired brain injuries, or early-onset dementia. If PIP was awarded retrospectively after a mandatory reconsideration or tribunal appeal, the entitlement dates back to the original claim date — which matters for backdating the SMI discount.

Disability Living Allowance (DLA)

DLA is a legacy benefit that has largely been replaced by PIP for working-age claimants, but many people still receive it — particularly those whose claims pre-date PIP's rollout or who were over 65 when DLA closed to new claims.

The care component of DLA is paid at three rates: lowest, middle, and highest. For SMI purposes, only the middle or highest rate qualifies. The lowest rate of DLA care does not meet the statutory threshold.

If the person receives DLA care at the lowest rate only, they do not satisfy the benefit condition for SMI — even if their cognitive impairment is severe. They would need to either successfully apply for a different qualifying benefit (such as Attendance Allowance, if over State Pension age) or have the DLA rate reassessed.

Universal Credit with LCWRA

Universal Credit qualifies when the award includes the Limited Capability for Work and Work-Related Activity (LCWRA) element — or the older Limited Capability for Work (LCW) element. This means the DWP has carried out a Work Capability Assessment and determined the person has limited capability for work-related activity.

Simply being on Universal Credit is not enough. A fit note, a health condition declaration, or a basic UC award without a formal Work Capability Assessment determination does not satisfy the test. The UC statement must show the LCWRA or LCW element explicitly.

With the completion of legacy benefit migration in 2025–2026, more working-age applicants will hold UC rather than ESA. If the person previously received income-related ESA with the support component and has been migrated to UC, verify that the UC award carries the LCWRA element — it should, but checking the award notice costs nothing and prevents a failed application.

Employment and Support Allowance (ESA)

ESA qualifies when it includes the support component or the work-related activity component. Assessment-phase ESA — the initial period before a Work Capability Assessment decision — does not count.

ESA is being phased out as claimants migrate to Universal Credit, but some people still receive it, particularly those on contribution-based ESA who are not affected by UC migration.

Other Qualifying Benefits

Several less common benefits also satisfy the test:

  • Armed Forces Independence Payment (AFIP) — for veterans with serious service-related injuries
  • Constant Attendance Allowance — paid as an increase to a War Disablement Pension or industrial disablement benefit
  • Severe Disablement Allowance — a legacy benefit; no new claims since 2001 but some people still receive it
  • Incapacity Benefit — short-term higher rate or long-term; largely replaced by ESA
  • Unemployability Supplement — paid under War Pensions schemes
  • Income Support with disability premium — where the applicable amount includes a disability or severe disability premium

What If the Benefit Was Awarded Retrospectively?

When the DWP awards a qualifying benefit after a reconsideration or tribunal appeal, entitlement is established back to the original claim date. This retroactive entitlement supports backdating the SMI council tax discount to the same date — provided the medical impairment was also present and the person was living at the property.

This matters most with PIP and Attendance Allowance, where DWP processing delays or initial refusals often push the award date months or years past the actual application date.

Next Steps

If the person you are supporting receives one of these qualifying benefits and has a severe, permanent impairment of intelligence and social functioning, they likely qualify for the SMI council tax discount. The next step is getting a GP certificate — which must be issued free of charge — and filing the claim with the council.

Our SMI Council Tax Exemption Guide covers the full process: which benefit satisfies the test, how to get the GP certificate, how to calculate and claim backdated refunds, and how to challenge a refusal.
