How to Appeal a Council Tax Premium in Scotland: Section 81, the Local Taxation Chamber and Deadlines

Disputing a council tax premium on your second home or empty property in Scotland is not a phone call or an email to customer service. It is a formal statutory process with hard deadlines; a late appeal needs an explanation and may not be accepted.

Stage 1: Section 81 Grievance

Every appeal starts here. Under Section 81 of the Local Government Finance Act 1992, you serve a written grievance notice on the council's revenues department. The notice must:

  • Identify the property and your council tax reference number
  • State the grounds of your grievance — why the premium should not apply, or why the classification is wrong
  • Specify what correction you are requesting

The council then has two months to investigate and issue a decision. If it agrees with your grievance, the account is adjusted. If it rejects it, you receive a written decision notice.

You cannot skip this step. The First-tier Tribunal will not hear your case unless you have first exhausted the Section 81 process.

Stage 2: Appeal to the Local Taxation Chamber

If the council rejects your grievance — or does not respond within two months — you can appeal to the First-tier Tribunal for Scotland (Local Taxation Chamber). The LTC took over from the old Valuation Appeal Committees on 1 April 2023 and handles all council tax liability disputes.

The critical deadline: your notice of appeal must reach the Tribunal within four months of the date you served the original grievance on the council. Not four months from the rejection — four months from when you submitted the grievance.

If you lodge the appeal late, the Tribunal's form asks you to explain the delay; do not rely on a late appeal being accepted.

Appeals are submitted by email to [email protected] or by post to Bothwell House, Hamilton Business Park, Hamilton. There is no online portal — it is email or post.

Stage 3: Upper Tribunal (Point of Law Only)

If you disagree with the LTC's decision, you can seek permission to appeal to the Upper Tribunal for Scotland. But this is limited to points of law — the Upper Tribunal will not re-examine the facts. The application must be made within 30 days of the LTC's decision notice.

You Must Keep Paying

Filing a grievance or an appeal does not suspend your obligation to pay the billed amount. If you withhold payment while the dispute is live, the council can proceed with enforcement — reminders, loss of instalment rights, and eventually a Summary Warrant application to the Sheriff Court (which adds a 10% statutory penalty surcharge).

If you win the appeal, the overpayment is credited to your account or refunded. But until that happens, the bill stands.

Common Grounds for Challenge

The most common disputes involve:

  • Misclassification: the council has categorised your property as a second home when it should be empty (or vice versa), leading to the wrong premium regime
  • Exception not applied: you submitted marketing evidence or renovation documentation, but the council rejected it as insufficient
  • Evidence dispute: the council disputes your 25-day occupancy claim or the genuineness of your marketing efforts
  • New-owner grace period: you recently bought the property and the council has not applied the mandatory 6-month renovation exception under Schedule 2, Paragraph 2A

Valuation Band Disputes Are a Separate Route

If your issue is with the council tax band itself (the property is banded too high), that goes through the Scottish Assessors Association and a different appeal process — not the Section 81 / LTC route. Band proposals are submitted to the local Assessor within six months of becoming the owner, with a six-week appeal window if the Assessor rejects the proposal.

The Scotland Second and Empty Homes Council Tax guide includes the full appeal timeline, template language for the Section 81 grievance notice, and the evidence standards the LTC applies when assessing premium disputes.
