Council Tax Reduction Scotland Appeal: Reviews and the Local Taxation Chamber
The Two-Stage Process
If your Council Tax Reduction has been refused, calculated wrong, or your backdating request was rejected, Scotland has a mandatory two-stage dispute process. You must complete Stage 1 before you can access Stage 2.
Stage 1: Internal council review — you ask your local council to look at the decision again.
Stage 2: External appeal to the First-tier Tribunal for Scotland (Local Taxation Chamber) — an independent tribunal reviews the council's decision.
The old Council Tax Reduction Review Panel (CTRRP) was abolished. All external appeal functions transferred to the Local Taxation Chamber in 2023.
Stage 1: Internal Council Review
You must request an internal review within two calendar months of the date on your CTR decision notice. This deadline is absolute — informal phone calls or service complaints don't pause it and can't extend it.
The review must be:
- In writing (letter, email, or the council's online dispute form)
- Submitted to the council that made the decision
- Clear about what part of the decision you disagree with and why
The council assigns a senior officer who wasn't involved in the original decision to conduct the review. They must issue a formal written determination within two calendar months of receiving your request.
If the council doesn't respond within two months, you gain the right to go straight to the tribunal.
What You Can Challenge
The review and appeal process covers disputes about:
- Eligibility decisions — the council says you don't qualify but you believe you do
- Award calculations — the income, capital, or applicable amount figures are wrong
- Non-dependant deductions — the wrong deduction rate has been applied, or an exemption hasn't been recognised
- Backdating refusals — you asked for backdating and were turned down
- Overpayment decisions — the council says you were paid too much
It does not cover:
- General service complaints about delays or poor communication
- Council tax band disputes (those go to the Scottish Assessors)
- Debt collection or enforcement complaints

Stage 2: The First-tier Tribunal (Local Taxation Chamber)
If the council's review decision is still wrong, or if the council failed to respond within two months, you can appeal to the Local Taxation Chamber (LTC).
Deadline: you must lodge your appeal within 42 calendar days of either:
- The date on the council's review decision notice, or
- The date the two-month council response window expired (if they never responded)
How to appeal: submit the official LTC appeal form online at localtaxationchamber.scot, by email, or by post. Include your original decision notice, the review outcome (if any), and your grounds for appeal.
Cost: completely free. No fees to lodge, no fees for the hearing.
Representation: you can represent yourself, bring a welfare rights adviser, or have a friend or family member speak for you. You don't need a solicitor.
What Happens at a Tribunal Hearing
The tribunal panel examines the legal basis of the council's decision. They can look at the income calculations, capital assessments, applicable amounts, non-dependant deductions, and backdating decisions. They have the power to overturn the council's decision and direct a new determination.
Hearings are typically straightforward. You explain your position, the council explains theirs, and the tribunal decides based on the law and the evidence. Written submissions are accepted if you can't attend in person.
Practical Tips
- Don't wait until the last day to request a review — postal delays or system issues could push you past the deadline
- Get specific in your review request — "I disagree" isn't enough. Identify which figures are wrong and what you believe the correct figures are
- Keep a dated record of every communication with the council, including when you sent your review request and how
- If the council decision notice is missing information (no financial breakdown, no appeal rights notice), note this — it may be legally defective
