Universal Credit LCWRA and Council Tax SMI Exemption

The Benefit Condition for Working-Age Claimants

Most guidance on the severe mental impairment (SMI) council tax discount focuses on Attendance Allowance and PIP — benefits associated with older adults and dementia. But with legacy benefit migration now complete, Universal Credit is increasingly the qualifying benefit for working-age people with severe cognitive impairments.

Universal Credit qualifies for the SMI council tax discount when its calculation includes an amount for Limited Capability for Work and Work-Related Activity (LCWRA) or Limited Capability for Work (LCW), or would include such an amount but for Regulations 27(4) or 29(4) of the Universal Credit Regulations 2013. A standard UC award with no qualifying LCW or LCWRA determination does not meet the statutory test, regardless of how severe the person's condition is.

What LCWRA Means

LCWRA stands for Limited Capability for Work and Work-Related Activity. It is normally determined through the DWP's Work Capability Assessment process; terminally ill claimants may be awarded it without a Work Capability Assessment. A person receives the LCWRA element when the DWP decides their health condition or disability means they have limited capability for work and work-related activity.

Since 6 April 2026, the LCWRA amount is £217.26 or £429.80 per assessment period, depending on the claimant's statutory rate category. The amount does not affect whether LCWRA satisfies the SMI benefit test under Article 3(2)(n) of The Council Tax (Discount Disregards) Order 1992, as inserted by S.I. 2013/630.

What Does Not Count

Several situations look similar but do not meet the statutory requirement:

  • A fit note or GP sickness certificate — this may exempt someone from job-searching temporarily, but it is not a Work Capability Assessment determination
  • Waiting for a Work Capability Assessment — until the DWP makes a formal decision, the LCWRA element is not in the UC award
  • A health condition declaration on the UC journal — reporting a health condition is not the same as being assessed and placed in the LCWRA group
  • UC with the work-related activity requirement removed for other reasons — such as caring responsibilities or pregnancy; the removal must be specifically due to a health-related Work Capability Assessment

The distinction matters: the council will check whether the UC calculation includes a qualifying LCW or LCWRA amount, or whether the statutory exceptions apply. If there is no qualifying determination and no applicable exception, the claim fails on the benefit limb, even if the person clearly has a severe mental impairment.

Migrating from ESA

Employment and Support Allowance (ESA) with the support component or work-related activity component also qualified for the SMI discount. As legacy benefits have been migrated to Universal Credit, people who previously held qualifying ESA should now hold UC with the LCWRA element — the two are equivalent in terms of what they reflect about the person's capability.

If someone was receiving ESA with the support component and has been migrated to UC, verify that the new UC award explicitly includes LCWRA. It should carry over automatically as part of the managed migration process, but checking the UC award notice takes a minute and avoids a problem later.

Anyone who had an SMI council tax discount based on ESA should inform the council of the benefit change and provide the new UC award notice. The discount continues without interruption if the UC calculation includes a qualifying LCW or LCWRA amount, or a statutory exception applies.

How to Prove LCWRA to the Council

The council needs documentary evidence that the UC award meets the qualifying LC or LCWRA condition. The simplest proof is:

  • The UC award notice (formerly called a "decision letter") showing the qualifying LCW or LCWRA amount and when it took effect
  • A UC statement from the online UC journal showing the qualifying amount in the payment breakdown

Some councils accept a screenshot of the UC journal payment page. Others insist on a formal award notice. If the person or their representative cannot find the original decision letter, they can request a copy through the UC journal or by calling the UC helpline.

The date the qualifying LCW or LCWRA amount took effect is critical for backdating. The SMI discount can be backdated to the latest of that date, the date of the certified severe mental impairment, and the date the person began living at the property.

The Bigger Picture

Universal Credit with LCWRA is one of eleven qualifying benefits for the SMI council tax discount. The benefit proves the DWP has assessed the person as having a severe health-related limitation. The GP certificate proves the person has a severe impairment of intelligence and social functioning that appears to be permanent. Together, they unlock a discount of 25% to 100% depending on who else lives in the household.

If you are supporting someone on UC with LCWRA who has a permanent cognitive impairment, the next step is getting the GP certificate — which must be issued free of charge — and filing the claim.

Our SMI Council Tax Exemption Guide covers the full process for every qualifying benefit, including UC LCWRA, with evidence checklists and backdating worksheets.
