Sandwell Council Tax SMI Exemption, Disabled Band Reduction and Carer Disregard

Discounts and Exemptions That Stack With CTR

Sandwell's Council Tax Reduction scheme doesn't exist in isolation. Several statutory discounts and exemptions are applied to your bill before CTR is even calculated, and some of them can reduce your liability to zero — making CTR unnecessary. Understanding the calculation order matters because getting a discount applied first can mean a bigger CTR award on the reduced amount.

Here's the hierarchy: statutory exemptions and discounts come first, then CTR is calculated on whatever liability remains.

Severe Mental Impairment (SMI) Exemption

The SMI exemption is one of the most valuable and most under-claimed council tax reliefs in England. If a person living in the property has been certified by a doctor as having a severe mental impairment — defined as a severe impairment of intelligence and social functioning that appears to be permanent — they can be "disregarded" for council tax purposes.

What this means in practice depends on who else lives in the property:

  • If the SMI-certified person lives alone, the property qualifies for a Class U exemption — the council tax bill is reduced to zero. No CTR needed, no minimum payment, nothing.
  • If other adults in the home are also SMI or are full-time students, a 100% discount can apply. If everyone else is disregarded for another reason, a 50% discount may apply instead.
  • If they live with one non-disregarded adult, the household gets the 25% single person discount because the SMI-certified person doesn't count for occupancy purposes. CTR then applies on the discounted amount.

The qualifying conditions include dementia, severe learning disabilities, and brain injuries that result in permanent cognitive impairment. The person also needs to be entitled to (not necessarily receiving) a qualifying benefit such as PIP daily living, DLA care component at the middle or highest rate, Attendance Allowance, ESA support component, or Universal Credit with a limited capability for work or work-related activity element.

To apply in Sandwell, contact the council tax team and request the SMI discount form. You'll need a certificate from a registered medical practitioner — typically the person's GP.

Disabled Band Reduction

If your property has been adapted to meet the needs of a disabled resident — with a room used predominantly for the disabled person's needs, an additional bathroom or kitchen for their use, or enough space indoors for a wheelchair to be used — you may qualify for a disabled band reduction. This drops your property down one band for council tax purposes: a Band C property is charged at Band B rates, Band B drops to Band A, and Band A drops to a special Band A-minus rate (five-ninths of the Band D charge).

This reduction is applied before CTR. For a working-age CTR claimant, it has a powerful knock-on effect: if your property is in Band C and it drops to Band B through the disabled band reduction, you're no longer caught by the Band B cap — your actual liability is already at Band B rates, so the cap doesn't add any extra cost.

Apply through Sandwell Council's council tax team. You'll need evidence of the adaptation and confirmation that a disabled person uses it.

Carer Disregard

A live-in carer may be disregarded for council tax purposes if they provide care for an average of at least 35 hours per week to someone entitled to a qualifying benefit. The carer must not be the person's spouse or partner, or the parent of a child under 18 they care for. This Council Tax disregard has no separate earnings limit; Carer's Allowance has its own eligibility rules.

Being disregarded means the carer doesn't count toward occupancy. If only the carer and the person they look after live in the property, the available discount or exemption depends on the cared-for person's status and the household's circumstances; a carer disregard alone does not create a full exemption.

For CTR calculations, disability benefits like DLA, PIP, and Attendance Allowance are fully excluded from the income assessment. Non-dependant deductions are not made if the claimant or their partner is registered blind or receives PIP daily living component, DLA care component at the middle or highest rate, or Attendance Allowance — so an adult child living in the household does not reduce the CTR award in those cases.

Student Exemption

Properties occupied entirely by full-time students are exempt from council tax under Class N. If a student lives with a non-student, the student is disregarded and the non-student may qualify for the 25% single person discount.

Full-time students are generally excluded from claiming CTR unless they're in a vulnerable category: single parents, disabled students on qualifying benefits, or student couples with dependent children. For most students in Sandwell, the Class N exemption or student disregard handles their council tax situation without needing CTR at all.

Check What Applies Before Claiming CTR

These discounts and exemptions reduce your liability before CTR is assessed. Getting them applied first — especially the SMI exemption or disabled band reduction — can mean a lower bill, a smaller minimum payment, or no bill at all. Missing them means you're claiming CTR on a higher base figure than necessary.

Our Sandwell Council Tax Reduction guide walks through how each discount interacts with the 85% cap and Band B restriction, with the exact calculation order so you can work out your real liability.
