How to Appeal a Council Tax Reduction Decision in Milton Keynes
When to Challenge a Decision
If Milton Keynes City Council has assessed your Council Tax Reduction claim and you believe the decision is wrong — the income figure is incorrect, a disregard was missed, the effective date is wrong, or your application was refused entirely — you have the right to challenge it through a formal process.
Informal phone calls do not count. The dispute process has two stages, and each has strict time limits.
Stage 1: Statutory Written Grievance
Before you can appeal to an independent tribunal, you must submit a formal written grievance to Milton Keynes City Council under Section 16 of the Local Government Finance Act 1992.
Your grievance should set out:
- Your name, address, and Council Tax reference number
- The specific decision you are disputing (quote the date and details from your decision notice)
- The exact grounds: what the council got wrong and what you believe the correct assessment should be
- Supporting evidence — payslips, bank statements, benefit letters, or anything that contradicts the council's figures
Submit the grievance through the council's online enquiry portal or email it to the Revenues and Benefits department. Keep proof of submission and the date.
Submit the grievance within 21 days of the decision notice.
The council has two calendar months to respond. During this period, they should review the decision and either uphold it, revise it, or issue a new calculation.
Stage 2: Valuation Tribunal for England
If the council rejects your grievance, only partially corrects the error, or fails to respond within two months, you can appeal to the Valuation Tribunal for England (VTE).
Key facts about the VTE:
- Filing deadline: within two months of receiving the council's final grievance response, or within four months of submitting the grievance if the council never responded
- Cost: free to lodge
- Representation: you can represent yourself, bring a friend or family member, or ask Citizens Advice for help
- Jurisdiction: the VTE can recalculate awards and enforce compliance with the scheme rules, but it cannot change Council Tax bands (that is a separate VOA process) or order discretionary Section 13A awards
Appeals are submitted through the VTE portal at valuationtribunal.gov.uk. The tribunal hears cases by phone, video, or in person.

You Must Keep Paying While You Appeal
A critical point many people miss: submitting a grievance or lodging a VTE appeal does not pause your Council Tax payments. You remain legally obligated to pay the billed amount until the dispute is resolved. If the appeal succeeds and you have overpaid, the council credits your account or issues a refund.
Ignoring the bill during an appeal can lead to a liability order and enforcement action, regardless of the outcome.
Common Grounds for a Successful Challenge
The most frequent errors that survive appeal are:
- Income miscalculated because a disregard was not applied (especially PIP or DLA income)
- Non-dependant deduction applied when the claimant qualifies for a waiver (receiving PIP Daily Living or DLA Care)
- Wrong effective date (the council started the award later than the Monday following receipt of the valid application)
- Capital assessment including assets that should be disregarded (for example, the value of the main home)
If your situation involves one of these, gather the specific evidence that contradicts the council's figure. A clear, factual grievance with supporting documents resolves most disputes before they reach the tribunal.
