Council Tax Reduction for Pensioners and Savings Rules in Leeds

Council Tax Support for Pensioners in Leeds

If you or your partner have reached State Pension age in Leeds, you are assessed under national pension-age regulations rather than the local working-age scheme. The differences are significant — and almost entirely in your favour.

The maximum council tax support for pension-age residents is 100% of the net liability, compared to the 75% cap that working-age claimants face. Backdating is automatic for up to three months without needing to prove good cause (working-age claimants must demonstrate continuous good cause for up to six months). And if you receive the Guarantee Credit element of Pension Credit, the £16,000 capital limit is waived entirely.

The £16,000 Capital Limit

The working-age scheme has a £16,000 upper capital limit. Pension-age claimants also have a £16,000 limit unless they or their partner receive Guarantee Credit, which removes that limit. Total household capital includes savings accounts, investments, ISAs, premium bonds, and the value of non-domiciliary property.

For working-age claims, capital above £6,000 and up to £16,000 is treated as tariff income of £1 a week for each £250, or part of £250. For pension-age claims, the first £10,000 is disregarded; above that, £1 a week is treated as income for each £500, or part of £500, up to £16,000. This "deemed income" is added to your other assessable income even though you are not spending your savings.

For a working-age claimant with £10,000 in savings:

  • Capital above £6,000: £4,000
  • Tariff income: £4,000 ÷ £250 = £16/week deemed income
  • That £16/week is added to your other income when calculating the surplus income deduction

The Guarantee Credit exception: If you or your partner receive the Guarantee Credit element of Pension Credit, the £16,000 upper capital limit does not apply and capital is disregarded in the calculation. This is why Guarantee Credit recipients often receive a full 100% council tax discount.

Mixed-Age Couples: Which Rules Apply

If one partner is pension-age and the other is working-age, the rules depend on the working-age partner's benefit status. If the working-age partner receives Universal Credit, income-based JSA, income-related ESA, or Income Support, the household is assessed under working-age scheme rules — meaning the 75% cap applies and the £16,000 limit stands without the Guarantee Credit exemption.

This catches couples where the older partner assumed pension-age rules would apply. It is the younger partner's benefit status that determines the scheme, not their age.

What Counts as Capital (and What Doesn't)

Leeds follows standard capital assessment rules. Capital includes bank and building society accounts, cash ISAs, stocks and shares, premium bonds, property you own but do not live in, and lump-sum payments.

Capital does not include the value of the home you live in, personal possessions, the surrender value of a life insurance policy, or business assets that you actively use in self-employment.

If you are subject to the capital limit, a recent lump sum — such as a redundancy payment or inheritance — could push your capital over £16,000 and end your CTS entitlement. The capital rules disregard specified benefit arrears for 52 weeks. Arrears of Pension Credit are treated as capital if paid for a period for which Council Tax Support had already been allowed.

Pension Credit: Why It Matters for CTS

Pension Credit comes in two parts. Guarantee Credit tops up your weekly income to a minimum level and, as noted above, exempts you from the capital tariff. Savings Credit rewards people who saved for retirement — but it is being phased out and is only available to people who reached State Pension age before 6 April 2016.

If you receive Guarantee Credit, your CTS claim is essentially passported: you are treated as having zero excess income, and capital is disregarded. The council still needs a formal CTS application, but the calculation almost always results in a 100% discount.

If you receive only Savings Credit (or neither element), the council runs the standard means test — income, capital, tariff income — and your award may be less than 100%.

Checking Whether You Are Missing Out

Many pension-age residents in Leeds are entitled to council tax support but have never claimed. In 2026/27, the standard Pension Credit Guarantee Credit amount is £238 a week for a single person and £363.25 for a couple, before any extra amounts. Contact the Pension Service on 0800 99 1234 to check your entitlement. A successful Pension Credit claim can qualify you for full council tax support, but Leeds still requires a CTS application.
