How to Avoid Council Tax on an Empty Property in Scotland

You cannot eliminate council tax on an empty property in Scotland simply by wanting to. But there are legitimate routes that reduce the bill, block the premium, or remove liability entirely — depending on your property's circumstances.

Routes That Remove Council Tax Entirely

These statutory exemptions wipe the bill to zero for the qualifying period:

Class A — Major structural repair: if the unoccupied property is undergoing major repair or structural alteration, council tax is exempt for up to 12 months from the date it was last occupied, subject to a maximum of 6 months after completion of the works. This requires evidence of genuine structural work — building warrants, contractor invoices, engineer reports. Cosmetic renovation does not qualify.

Class E — Former resident in care: if the owner has moved permanently into a care home or hospital, the property is fully exempt for as long as it remains unoccupied and the person remains in care.

Class F — Deceased estate: an inherited property is exempt until Confirmation (Scotland's equivalent of Probate) is granted, plus six months.

Class G — Legally prohibited occupation: a property subject to a closing order, demolition order, or other statutory prohibition on occupation is fully exempt.

Routes That Block the Premium (But Not the Base Tax)

Even when you cannot remove the base council tax, you may be able to prevent the premium surcharge:

Marketing exception: if the property is actively marketed for sale or let at a realistic price, the premium is blocked for up to two years. Evidence must include an estate agent contract, Home Report, and live listings.

New-owner renovation exception: bought the property recently? A mandatory 6-month grace period under Schedule 2, Paragraph 2A prevents the premium while repairs are underway. Councils can extend this.

Job-related dwelling: if the property relates to your employment conditions, no premium applies and you receive a mandatory 50% discount.

Letting as a Strategy

If a tenant uses the property as their sole or main residence, it is no longer treated as an unoccupied dwelling for these premium rules. Who is liable for council tax depends on the tenancy and statutory liability rules.

Short-term letting through holiday platforms can work too, but only if you meet the 70/140-night threshold for non-domestic rates. Fall below it and the property reverts to the council tax list as a second home (if furnished and used 25+ days) or empty property.

What Does Not Work

Brief occupation to reset the clock: moving someone in for a few weeks does not help. Scotland's 6-week anti-avoidance rule means any occupation shorter than six weeks is legally disregarded — the clock continues as if the property was never occupied.

Removing furniture: stripping a second home of its furniture changes the classification from "second home" to "empty property." Most empty, unfurnished homes are exempt for the first six months after last occupation; after that, local discounts or exemptions may apply, and a long-term empty-home premium can apply after 12 months.

Ignoring the bill: non-payment triggers enforcement — reminder notices, loss of instalment rights, and eventually a summary warrant with a 10% penalty surcharge. Filing an appeal does not pause the obligation to pay.

Claiming an exemption you do not qualify for: councils verify claims with documentary evidence and occupancy questionnaires. A false claim risks a £500 statutory penalty for failing to declare occupancy status.

The Realistic Position

For most owners, the question is not whether any council tax is payable — it is — but which relief category minimises the charge. The right answer depends on the property's facts: its condition, how long it has been empty, what you plan to do with it, and which council area it sits in.

The Scotland Second and Empty Homes Council Tax guide maps out every relief category with evidence checklists, worked calculations, and the timeline showing how exemptions, exceptions, and the empty-home clock interact.
