DWP Benefits, ESA, and Managed Migration: Council Tax Reduction in County Durham
DWP Benefits Are Fully Disregarded in Durham's CTR Scheme
Under County Durham's 2026/27 working-age Council Tax Reduction scheme, every benefit paid by the Department for Work and Pensions is 100% disregarded when calculating your assessed weekly income. This includes:
- Employment and Support Allowance (ESA) — both income-related and contribution-based
- Universal Credit (the full award including all elements)
- Jobseeker's Allowance (JSA)
- Personal Independence Payment (PIP)
- Disability Living Allowance (DLA)
- Carer's Allowance
- Attendance Allowance
- Incapacity Benefit (for anyone still receiving it)
If DWP benefits are your only income and your capital is below £6,000, your assessed weekly income for CTR purposes is £0. You fall into Band 1 (£0–£69.99) and receive the standard maximum 90% discount; a qualifying terminal-illness case supported by an SR1 can receive 100% for up to 12 months.
The practical effect for ESA claimants is significant. ESA, including a support component, does not count toward your council tax assessment. Earnings, other countable income, and any tariff income from capital can still affect your band.
What Happens During Managed Migration to Universal Credit
The DWP is moving remaining legacy benefit claimants — including some people on ESA, income-related JSA, and Tax Credits — to Universal Credit through a process called managed migration. If you receive a migration notice, follow the deadline stated in your notice to claim Universal Credit before your legacy benefits stop.
Here is the critical point for council tax: moving to Universal Credit does not automatically transfer your Council Tax Reduction claim. CTR is administered by Durham County Council, not the DWP. When your legacy benefits end and Universal Credit begins, you must ensure your CTR claim is updated — or submit a new one if it has lapsed.
The risk during managed migration is a gap in CTR cover. If your ESA stops and you switch to Universal Credit, the council needs to know about the change. Under Durham's rules, if you submit your CTR application within one calendar month of notifying the DWP of your intention to claim Universal Credit, the council backdates the CTR application date to the first day of the relevant UC assessment period. If you miss that window, the usual start-date rule applies: an award normally takes effect on the Monday after the council receives your application.
Steps to Protect Your CTR During Migration
Before migration: Check whether you currently receive Council Tax Reduction by looking at your latest council tax demand notice. If CTR is already applied, note the discount percentage and your current income band.
When you receive the migration notice: Make your Universal Credit claim by the deadline in the notice. Then, within one calendar month of notifying the DWP that you intend to claim UC, contact Durham County Council on 03000 26 0000 or apply online at durham.gov.uk/counciltaxreduction to confirm or update your CTR. Even if the council receives information from the DWP, that does not complete a separate CTR application on your behalf.
After migration: If your UC award includes a transitional element, Durham disregards it as part of your UC award. The UC award itself is disregarded; only earned net employment income reported by the DWP counts toward your CTR income band. Other scheme rules, including the capital limits, still apply.

ESA Support Group and Additional Protections
If you are in the ESA support group, these separate CTR rules may be relevant during migration:
Non-dependant deduction waiver: The £10 per week deduction is waived if you or your partner receives PIP daily living, DLA middle/high rate care, or AFIP, or if either of you is registered blind. You do not need to receive ESA for this waiver.
Terminal illness: If you have an SR1 medical form confirming a terminal diagnosis, Durham automatically upgrades your CTR from the standard 90% maximum to 100% for up to 12 months.
Severe mental impairment: If you are medically certified as severely mentally impaired and receive a qualifying benefit, you may qualify for the separate severe mental impairment council tax exemption. Ask Durham County Council which benefits and medical evidence meet its criteria.
Contribution-Based ESA and Savings
One area that catches people out: contribution-based ESA (or the UC equivalent — UC without an income assessment) does not affect your CTR income calculation because it is a DWP benefit and therefore disregarded. But if you are on contribution-based ESA, you may have savings or a partner's income that does count.
Remember the capital rules: savings above £10,000 disqualify you entirely from working-age CTR. Between £6,000 and £9,999.99, tariff income of £1 per week per £250 above £6,000 is added to your assessed income. If you received a redundancy payment or insurance payout before becoming ill, check where your savings sit relative to these thresholds.
Do Not Wait for the Council to Contact You
The single biggest mistake during managed migration is passivity — assuming the system will update your council tax automatically. It does not. The DWP and the council share data, but the council cannot complete a CTR assessment without your application and supporting evidence.
For the full process — how to calculate your income band, what evidence the council needs, and how to apply for hardship relief if the 10% minimum payment is unaffordable — the County Durham Council Tax Reduction guide covers everything in one walkthrough.
