Council Tax Student Exemption Backdated: How to Get a Refund

There Is No Statutory Time Limit on Backdating

This is the most important thing to know: there is no limitation period in the Local Government Finance Act 1992 that prevents you from claiming a council tax exemption or discount retroactively.

Section 2(2) of the LGFA 1992 says liability is determined on a daily basis. If you were legally entitled to a student disregard or your property satisfied Class N exemption criteria on past dates, the council must adjust your historical account. Council websites that say backdating is "limited to 12 months" or "the current tax year" are stating administrative preference, not law.

If you've been paying council tax while you were a full-time student — or while everyone in your household was a student — you can claim back what you shouldn't have paid, regardless of when it was.

How to Make a Retrospective Claim

The process is straightforward, but it requires evidence that your student status applied during the past period:

  1. Get retrospective student certificates. Contact your university's student records office and request council tax certificates covering the historical period. Most universities can issue certificates for former students going back several years. The certificate must confirm you met the full-time criteria (24 weeks per year, 21 hours per week) during the period in question.

  2. Write to the council's revenues department. Don't use the standard online exemption form — those typically only handle current claims. Write a letter or email to the council tax team explaining that you're claiming a retrospective exemption or discount. State the exact dates you're claiming for and attach the certificates for every resident who qualified.

  3. Specify what you're claiming. Are you claiming a full Class N exemption (all residents were students) or a discount disregard (you were a student living with non-students, so the bill should have been reduced by 25%)?

  4. Request a revised demand notice. Ask the council to recalculate liability for each billing year affected and issue a revised bill showing the credit.

Getting the Refund

When the council adjusts your historical account and a credit balance emerges, they must refund the overpaid amount to the person who paid it. This comes as a bank transfer, cheque, or credit against your current council tax account if you still live in the area.

For mixed households, the council recalculates on a daily basis. If you and a working housemate shared a flat for a year and were billed at 100% when you should have had a 25% discount, the retrospective adjustment reduces the bill to 75% for that period and refunds the 25% overpayment.

One thing to watch: the refund goes to whoever paid the bill. If your housemate or landlord paid the council tax directly, the refund is issued to them — not to you. Any private settlement between housemates about who should receive the money is a contractual matter between you, not something the council mediates.

When Councils Push Back

Some councils resist backdated claims, particularly for periods several years in the past. They may cite internal policies limiting backdating. If they refuse:

  1. Put your claim in writing if you haven't already — this creates a formal record
  2. Reference Section 2(2) of the LGFA 1992 (daily liability determination) and the absence of any statutory limitation period
  3. If they still refuse, serve a formal Section 16 grievance notice. The council then has 2 months to respond
  4. If they reject your grievance or don't respond, you can appeal to the Valuation Tribunal for England for free

The VTE has the power to order the council to apply the exemption retrospectively and issue a refund.
