Council Tax Reduction Scotland Temporary Absence: Hospital, Care Home and Travel Rules

The Basic Rule

Council Tax Reduction requires you to occupy your home as your sole or main residence. If you're temporarily away, you can keep your CTR as long as the absence falls within the statutory time limits and you intend to return.

There are two limits:

  • 13 weeks for absences within Great Britain (England, Scotland, Wales)
  • 4 weeks for absences outside Great Britain

Beyond these limits, the council treats you as no longer occupying the property, and your CTR ends. You would need to submit a new application when you return.

Hospital Stays

Being admitted to hospital counts as a temporary absence from your home. If the admission is expected to last less than 13 weeks, your CTR continues without any action from you — you don't need to tell the council.

If the stay looks likely to exceed 13 weeks, notify the council before the 13-week point and ask it to assess how the absence affects your claim.

During a hospital stay, your household composition may change if other residents also leave or if a partner continues living in the property. Any changes (like income changes or a non-dependant moving out) still need to be reported within the standard one-month deadline.

Disability benefits such as Adult Disability Payment (ADP) and PIP are not counted as income for CTR, but qualifying awards can affect whether you receive a disability premium. Tell your council if a change to your benefit affects that entitlement.

Care Home Admission

Moving into a care home raises different questions depending on whether the move is temporary or permanent.

Temporary care home stays (under 13 weeks): Your CTR continues on the same basis as any other temporary absence. The home you left remains your sole or main residence as long as you intend to return.

Permanent care home admission: Once it's clear the move is permanent, the care home becomes your main residence. Your CTR on the previous property ends. The property may qualify for a Council Tax exemption under separate billing rules; ask your council about the rules for your circumstances.

If you're in a care home and liable for Council Tax there (which is rare — care homes are usually exempt residential institutions), CTR rules apply as normal based on your income, savings and household at the care home address.

Respite care: Short stays in a care home or respite facility for a few days or weeks at a time count as temporary absences. Tell your council if a stay may take you beyond the 13-week limit.

Going Abroad

The standard limit for an absence outside Great Britain is four weeks. If you expect to be away longer, contact your council before you leave to ask how the absence affects your claim.

A common mistake is booking a six-week holiday and assuming your CTR will simply pause and restart when you return. If your entitlement ends, contact the council about making a new claim. The standard start date for a working-age claim is the Monday after the council receives the application; separate backdating rules apply to pension-age claims.

For shorter overseas trips (under four weeks), no action is needed and your CTR continues.

Students and Term-Time Absence

Full-time students are generally excluded from CTR, but those who qualify through an exception (lone parents, disabled students, students with children) need to be aware of the absence rules during vacations. If a qualifying student leaves their term-time address during holidays:

  • Trips within Great Britain: the 13-week rule applies
  • Trips abroad: the 4-week rule applies

If the student's main home changes (moving back to a parent's home during a long vacation), CTR at the student address may end.

What to Report

You must tell your council if you'll be away for an extended period. The safest approach:

  • Under 4 weeks (any destination): No need to report, though it's sensible for extended travel
  • More than 4 weeks abroad: Report before you leave
  • Approaching 13 weeks within Great Britain: Report before the 13-week point

Failure to report and exceeding the limits can result in an overpayment — the council will reclaim the CTR paid for the period after the limit expired.

Managing Your Claim Through a Change

Temporary absences are one of several life changes that affect an active CTR claim. The full process — including how to report changes, what evidence is needed and how to challenge a decision you disagree with — is covered in the Council Tax Reduction in Scotland guide.
