Council Tax Premium Exceptions Wales: All 7 Classes Explained

Receiving a council tax premium demand does not mean you have to pay it. The Council Tax (Exceptions to Higher Amounts) (Wales) Regulations 2015 set out seven national exception classes — and if your property falls into one, the council is legally barred from charging the premium.

Classes That Apply to Both Empty Homes and Second Homes

Class 1 — Marketed for sale. The property must be on the open market at a reasonable price. "Reasonable" means comparable to recent Land Registry sales for similar properties nearby. The exception lasts up to 12 continuous months and cannot be reused unless the property changes hands (freehold transfer or a lease of at least seven years).

Class 2 — Marketed for let. The same principle as Class 1, but for rental. The property must be actively marketed at a reasonable market rent, with evidence of a letting agency contract, public listings, and viewings. Duration: up to 12 months. It cannot be reused unless the property has subsequently been let on a genuine tenancy for at least six months.

Class 3 — Annexe. The dwelling is an annexe forming part of, or treated as part of, a main dwelling. You need council tax banding evidence, structural plans, and proof of shared utility supply or integrated family use.

Class 4 — Armed forces. The owner or tenant occupies Ministry of Defence accommodation and would otherwise use this property as their main home. Evidence: MoD occupancy agreement or posting order.

Classes That Apply Only to Second Homes

Class 5 — Caravan pitches and boat moorings. The pitch or mooring is currently unoccupied but will be used for a caravan or boat when next in use.

Class 6 — Planning restrictions. Class 6 applies when a planning condition prevents occupation for a continuous period of at least 28 days in any 12-month period, specifies holiday-let-only use, or prevents the dwelling from being occupied as anyone's sole or main residence. A condition that merely restricts commercial sub-letting does not qualify.

Class 7 — Job-related dwelling. Your employer contractually requires you to live in a specific property elsewhere for work. This covers resident caretakers, boarding school housemasters, ministers of religion, and similar roles — but not voluntary residence near a workplace or remote working.

The Incoming Class 8

From 1 April 2027, a transitional Class 8 exception covers properties that were on the non-domestic rating list as self-catering accommodation but failed the letting thresholds and reverted to council tax. The exception lasts 12 months from the date of reclassification.

Local Discretionary Exceptions

On top of the seven national classes, some councils run their own local schemes. Newport offers a three-month new-owner grace period and a local renovation exception. Merthyr Tydfil has a renovation relief lasting up to six months. These vary by authority and change year to year — check your council's own policy.

Applying for an Exception

There is no national application portal. You apply directly to your billing authority using their specific forms (usually online, sometimes paper). The council assesses your evidence on the balance of probabilities. To challenge a decision, first send the council a formal written Section 16 grievance. If it rejects the grievance, you may appeal free to the Valuation Tribunal for Wales within two months of the decision notice. If the council does not respond within two months, the appeal must reach the tribunal within four months from the date you submitted the grievance.

The Wales Premium Exceptions Guide includes evidence checklists for each class, council-by-council application routes, and a step-by-step appeal framework.
