Council Tax — One Student, One Working Person: Who Pays?
The Short Answer
For a standard joint tenancy, the working tenant pays the council tax. The student has no statutory council tax liability.
Under the Local Government Finance Act 1992, full-time students in England are "disregarded" — the council does not count them when working out how many adults live in a property. In a household with one student and one working person, the council sees one countable adult. If the working person is the liable resident under the statutory hierarchy, they get a 25% single-person discount and pay 75% of the standard council tax bill. Liability can differ in other property arrangements, including some HMOs where the owner is liable.
The student is not just exempt from the bill — they are legally excluded from joint and several liability. Section 6(4) of the LGFA 1992 says the joint liability rule "shall not apply" to any resident who is disregarded as a student. The council cannot name the student on the demand notice, cannot pursue the student for arrears, and cannot send enforcement agents after the student for any part of the charge.
What About Married Couples and Civil Partners?
Same rule. Section 9 of the LGFA 1992 normally makes spouses and civil partners jointly and severally liable for council tax. But Section 9(2) disapplies this where one partner is a disregarded student. The working spouse or civil partner is solely liable. The student partner cannot be pursued.
This was confirmed by the Court of Appeal in Sheffield City Council v Turton (2002) — spousal joint liability does not override the statutory student disregard.
How Much Does the Working Person Pay?
Exactly 75% of the standard council tax charge for the property's band. The 25% reduction is the standard single-person discount, applied whenever only one countable adult lives at an address. It is not a special "student discount" — the student's disregard simply creates the single-occupant condition.
If the working person is on a low income, they may also qualify for Council Tax Reduction (means-tested support run by the local council), which could reduce the 75% further.

What If There Are Two Working People and a Student?
The student is still disregarded, but with two non-disregarded adults in the property, the single-person discount does not apply. The two working residents pay the full 100% charge and are jointly and severally liable. The student still owes nothing.
The Flatmate Argument
This is where council tax rules and personal agreements collide. The law is clear — the student has no statutory liability. But tenancy agreements or informal house rules sometimes say tenants split all bills equally. Those are private contractual arrangements between housemates. The council does not enforce them and has no jurisdiction over them.
If a non-student housemate insists the student should contribute, that is a private negotiation — not a legal obligation. The council will not add the student to the bill regardless of what the tenancy agreement says.
How to Get the Discount Applied
The student needs to provide a valid council tax student certificate to the billing authority. Once the council verifies that the student qualifies for disregard, it will recalculate the account and apply the 25% discount.
If the discount should have applied from an earlier date, ask for the account to be backdated. There is no statutory time limit on retrospective claims — if you can prove the student was enrolled full-time in previous years, the council must adjust the account and refund any overpayment.
