Council Tax Section 16 Review and Valuation Tribunal Appeal Process
Your council has assessed your council tax support claim and the number looks wrong. Maybe your income was miscalculated, a disregard was missed, or a non-dependant deduction was applied when it shouldn't have been. You don't have to accept it — there's a formal two-stage dispute process, and the second stage takes you to an independent tribunal that's free to use.
Stage 1: Written Grievance Under Section 16
Before you can appeal to the Valuation Tribunal, you must first raise a formal written complaint — technically a Section 16 grievance under the Local Government Finance Act 1992 — directly with your billing authority.
This isn't a phone call or a casual email asking them to look again. It needs to be a written submission stating specific grounds: which part of the decision you believe is wrong and why. Common grounds include:
- Your income was calculated incorrectly (wrong earnings figure, missing disregard)
- Your household composition was recorded wrongly (missed a disability premium, wrong non-dependant count)
- A discount or exemption should have been applied but wasn't
- Backdating was refused when you had continuous good cause
Submit the grievance by post or through the council's official appeal form. Keep a copy and note the date you sent it — the statutory clock starts from when the council receives your complaint.
The Council's Response Window
Your council has two months to review the decision and respond in writing. During this time, they might:
- Revise the decision in your favour (the complaint resolved the issue)
- Uphold the original decision and explain why
- Request additional evidence from you
- Fail to respond at all
If the council doesn't respond within two months, you're not stuck — that silence opens the door to Stage 2.
Stage 2: Valuation Tribunal for England (VTE)
The Valuation Tribunal is an independent judicial body. It's completely separate from your council, and appealing to it is free.
If the council responded to your Section 16 grievance: you have two months from the date of their response to lodge a tribunal appeal.
If the council didn't respond: the appeal window opens at two months from your original grievance and closes at four months. So if you complained on 1 March and heard nothing back by 1 May, you can appeal from 1 May and must file by 1 July.
Appeals can be submitted online through the Valuation Tribunal Service website or by post to Valuation Tribunal Service, Hepworth House, 2 Trafford Court, Doncaster, DN1 1PN.

What the Tribunal Can (and Can't) Do
The VTE checks whether your council correctly applied its own scheme rules and the relevant statutory regulations. If the tribunal finds the council made a calculation error, applied the wrong disregard, or misinterpreted its own policy, it can order the decision to be revised.
What the tribunal can't do is change the scheme itself. If your council caps working-age support at 80% and you think it should be 100%, that's a policy decision — the tribunal has no power to override it. The dispute must be about how the rules were applied to your specific case.
Practical Tips
Don't wait for the tribunal to sort out arrears. Your council tax bill remains due while the dispute is in progress. If the appeal succeeds, you'll get a revised bill and any overpayment credited to your account. But if you stop paying during the process, the council can still pursue enforcement action.
Get help with your appeal. Citizens Advice, local law centres, and specialist welfare rights advisers can help you prepare your grounds and represent you at the tribunal hearing. Coventry residents can contact Central England Law Centre (024 7622 3053) for specialist legal representation on complex appeals.
Keep records of everything. Every letter, email, and date. Treat the two-month and four-month deadlines seriously. If circumstances beyond your control mean you cannot appeal in time, you may still be able to submit a late appeal, so contact the Valuation Tribunal promptly.
