Council Tax Exemption During PhD Writing-Up and Viva Corrections
Writing-Up Does Not Automatically End Your Exemption
Billing authorities sometimes treat a PhD student's transition to writing-up status as the end of their course. This is wrong. Under the Council Tax (Discount Disregards) Order 1992, a person is regarded as undertaking a course from the official start date until completion, abandonment, or dismissal. If you remain formally enrolled with your university and the course still meets the full-time criteria, including at least 21 hours per week of required study, you may continue to qualify for the student disregard.
The legal test does not change because your university labels you as "writing up" rather than "in research." What matters is continuous enrolment on a full-time course and meeting the hours threshold. Valuation Tribunal decisions have confirmed that formal university enrolment within the official course period, combined with the statutory commitment of hours, retains the disregard.
The Certificate Problem
The difficulty is practical, not legal. Many universities issue writing-up certificates that say something like "this student is registered for thesis writing-up" without explicitly confirming the 21-hour/24-week thresholds. Billing authorities routinely reject these certificates because they do not contain the statutory wording.
If your university's writing-up certificate is vague, contact the academic registry or your doctoral school and ask for a certificate that specifically states:
- You are enrolled as a full-time student
- The course (your PhD programme) meets the 24-week and 21-hour criteria
- The start date and expected completion date of the course
Some registries will push back, arguing that writing-up students are not full-time in the same way as students attending lectures. Escalate to the student welfare team or doctoral school director if needed — the university has a statutory duty to issue the certificate for any eligible student, and the test is about the nature of the work, not the label.
Viva Corrections
The same test applies during viva corrections. If you are awaiting a viva or completing corrections, you may qualify if the university confirms that you remain enrolled on a qualifying full-time course and the required work still meets the statutory study threshold.
The danger point is when the university's certified course period ends or your course is formally completed. From the official course end date, the student disregard lapses — even if the graduation ceremony is months away.

Self-Funded Writing-Up
Some universities move PhD students from funded to self-funded writing-up status. If this change also reclassifies you as part-time, you may lose the disregard. Check your enrolment and course requirements carefully: your council tax position depends on whether the statutory criteria are met, and the university certificate is evidence of your status.
What to Do If the Council Rejects Your Claim
If your billing authority refuses to accept your writing-up certificate, do not accept the decision quietly. Write a formal challenge under Section 16 of the Local Government Finance Act 1992, citing your continuous enrolment and the statutory hours threshold. The student exemption guide includes the written challenge framework and Valuation Tribunal escalation process.
