Council Tax Carer Disregard Wales: 35-Hour Rule, Qualifying Benefits and How to Claim

You Don't Need Carer's Allowance

The most common misconception about the council tax carer disregard is that you need to be receiving Carer's Allowance. You don't. Under Regulation 18 of W.S.I. 2026/8, the disregard depends on how many hours you care, who you care for, and whether the person you care for is entitled to a qualifying benefit — not whether you've claimed a carer benefit yourself.

If you meet the conditions, the council removes you from the household count entirely. That can trigger a 25% single person discount for whoever remains, or a 50% all-disregarded discount if every adult in the home is also disregarded and the property does not qualify for a full exemption (for example, a person with SMI living with an unrelated resident carer who meets the conditions).

The Three Conditions for Unpaid Carer Disregard

All three must be met simultaneously:

1. You provide at least 35 hours of care per week. This is an average — some weeks more, some less. The care includes physical help, supervision, and emotional support related to the person's disability or condition.

2. The person you care for is entitled to a qualifying disability benefit. The entitlement must be for the person receiving care, not for you. Qualifying benefits include:

  • Attendance Allowance (AA)
  • PIP daily living component (standard or enhanced)
  • DLA care component at the middle or highest rate
  • Constant Attendance Allowance (Industrial Injuries or War Pensions)

3. You live in the same dwelling as the person receiving care. If you care for someone who lives at a different address, you don't qualify for the carer disregard — though the property you left empty might qualify for a Class J exemption.

The Spouse and Partner Exclusion

Here's the rule that trips people up: you cannot claim the carer disregard if you are the spouse, civil partner, or cohabiting partner of the person you care for. A wife caring full-time for her husband with dementia doesn't qualify. Neither does a husband caring for his wife after a stroke.

But adult children caring for elderly parents? They qualify. Siblings caring for siblings? They qualify. A grandchild living with and caring for a grandparent? They qualify. The exclusion is narrow — it only blocks partners.

There's also a secondary exclusion: a parent caring for their own child under 18 doesn't qualify. But a parent caring for an adult child (18+) does.

What the Disregard Actually Saves

The savings depend on who else is in the household:

You're the only other adult. If the person you care for has SMI (and is already disregarded themselves), removing you from the count means zero counted adults. That's a 50% all-disregarded discount — or a Class U exemption if the only occupants are SMI-certified.

There are three adults and you're disregarded. If one other adult remains counted, the household gets a 25% discount. If both remaining adults are also disregarded (students, for example), it's 50%.

Using Wrexham County Borough Council's average Band D charge of £2,308.88 for 2026/27, a 25% discount saves about £577 per year and a 50% discount about £1,154.

How to Apply

Contact your local council's revenues department. Swansea has a dedicated online "unpaid carer's discount" form. Cardiff uses its general council tax discount application. Most other Welsh councils accept written applications or phone calls.

You'll need to provide:

  • Your name, address, and council tax reference number
  • The name of the person you care for and their relationship to you
  • Evidence of their qualifying benefit (award letter showing benefit type and start date)
  • A statement of the approximate hours of care you provide per week

The disregard takes effect from the date the conditions were first met, not the date you apply. If you've been providing 35+ hours of care for the past two years without claiming, the council must backdate the adjustment.

When the Carer Disregard Stacks with SMI

The most powerful combination is a household where one person has SMI (disregarded under Regulation 10) and another is their unpaid carer (disregarded under Regulation 18). Both adults are removed from the count, and the property gets a 50% discount or potentially a full Class U exemption.
