Council Tax Arrears and Enforcement in Cheshire West and Chester

How Council Tax Enforcement Escalates

Council tax debt moves faster than most people expect. Unlike commercial debts, local authorities have their own enforcement powers and do not need to go through the county court process.

The typical sequence in Cheshire West and Chester:

  1. Reminder notice: sent after you miss a payment. You have seven days to pay.
  2. Final notice: if you miss again, the council demands the full remaining annual balance immediately — not just the overdue instalment.
  3. Summons: the council applies to the Magistrates' Court for a liability order. Court costs are added to your debt.
  4. Liability order: once granted, the council can use enforcement agents (bailiffs), apply for an attachment of earnings, deduct from benefits, or in severe cases apply for a charging order on your property.

The entire process from first missed payment to liability order can happen within a few months. Once a liability order is in place, the debt is significantly harder to negotiate down.

What Bailiffs Can and Cannot Do

Enforcement agents must follow the Taking Control of Goods Regulations 2013. On a first visit, they cannot force entry to your home — they can only enter through an open door or if you let them in. They must provide a written notice of enforcement at least 14 clear days before they can take control of your goods.

Certain items are exempt from seizure: essential household goods (beds, cookers, fridges, washing machines), items used for work up to £1,350 in value, and items belonging to anyone other than the debtor.

Since 1 May 2026, the fixed enforcement fees are £79 at the compliance stage, £247 at the enforcement stage, and £116 at the sale or disposal stage. The enforcement and sale stages can also add a 7.5% fee on the portion of the debt above £1,900. Ask for an itemised breakdown of the fees and any additional charges.

Get Free Debt Advice First

If you are already facing enforcement, do not try to handle it alone and do not pay a commercial debt management company. Free, regulated debt advice is available from:

  • StepChange Debt Charity: 0800 138 1111 (stepchange.org)
  • National Debtline: 0808 808 4000 (nationaldebtline.org)
  • Citizens Advice Cheshire West: 0808 278 7806

These charities can help you access Breathing Space — a statutory moratorium of up to 60 days that can pause enforcement action, interest, and fees on qualifying debts. During the moratorium, collection activity covered by the scheme is paused, giving you time to get proper advice and set up a repayment plan.

Claiming CTR Can Still Help

Even if you are already in arrears, applying for Council Tax Reduction can reduce your ongoing liability. A successful CTR claim will not wipe out past debt, but it lowers the amount being added to your account each month, making the overall situation more manageable.

If the arrears built up because you did not know you needed to apply separately from Universal Credit, a backdating request (up to three months with good cause) may also reduce the arrears balance.

The Cheshire West Council Tax Reduction guide explains how to apply and backdate your claim. For the debt itself, speak to one of the free advice charities above — they deal with council tax arrears daily.
