Care Leavers, Disability, and Council Tax Relief in Scotland

Council Tax Relief for Care Leavers in Scotland

Care-leaver council tax support is separate from the SMI relief covered here. Ask the relevant council whether any separate care-leaver support applies and which current criteria govern it.

SMI relief has its own criteria regardless of care-leaver status. Other disability-related council tax reliefs may also be available separately.

Care-Leaver Support and SMI Relief

There is no single care-leaver rule within the SMI disregard. Any separate care-leaver support should be confirmed with the billing authority.

SMI relief has its own statutory criteria and does not depend on care-leaver status.

When Any Care-Leaver Support Ends

If separate care-leaver support ends, other council tax relief may still be available, depending on the person's circumstances.

SMI disregard: If the care leaver has a severe impairment of intelligence and social functioning — from a severe learning disability, brain injury, or other condition — and meets the qualifying benefit condition, they can be disregarded while all SMI conditions are met. There is no age limit on the SMI disregard.

Disabled band reduction: If their property has been adapted for disability needs (additional bathroom, wheelchair space, or a room used predominantly for the disabled person), the band reduction is assessed separately from any care-leaver support.

Council Tax Reduction: CTR is means-tested and assessed separately from the SMI disregard. Ask the council how the household's income and other circumstances affect eligibility.

Overlapping Reliefs Before Care-Leaver Support Ends

A care leaver who qualifies for an SMI disregard may also have separate care-leaver support. The council tax outcome depends on the applicable rules; the SMI disregard changes the chargeable-adult count and may not add savings if the bill is already nil.

Applying for the SMI disregard before separate care-leaver support ends can help the council assess the next entitlement without delay.

Applying for a Care Leaver with a Learning Disability

Some care leavers with severe learning disabilities may have a history of qualifying benefits, such as DLA, Child Disability Payment, Adult Disability Payment, or Scottish Adult Disability Living Allowance. The specific qualifying component and dates matter. If they meet all three SMI conditions — functional impairment, medical certification, and qualifying benefit — the disregard should be applied.

The practical challenge is often the application process itself. A care leaver with a severe learning disability may not have a family member to help navigate the paperwork. Throughcare and aftercare teams at the local authority, along with advocacy organisations like Enable Scotland, can assist with the application.

Local authority welfare rights officers can also help. Since the council is both the support provider and the tax authority, there's a strong argument that throughcare teams should proactively identify care leavers who qualify for disability-related council tax relief — though in practice this doesn't always happen.
