Care Leaver Council Tax Backdating: How Far Back Can You Claim
Most Councils Will Backdate
If you've been paying council tax that you shouldn't have owed, most adopted care-leaver policies limit automatic backdating to the start of the current financial year in which you apply. Some councils allow a longer period under their local policy.
The backdating period varies by council. Manchester and Bury backdate to 1 April 2018 (when their policies took effect) or to the occupation date, whichever is more recent. Bristol's policy took effect on 1 April 2018 as well. North Northamptonshire will consider backdating to the start of the financial year or to the date you became responsible for council tax if that date is within 12 months of your application; it cannot award relief before 1 April 2021. Check both the policy's effective date and any look-back limit.
There is no national statutory limit on how far back Section 13A(1)(c) relief can be awarded. The constraint is the council's own policy wording: most councils specify a start date, and the discount can't predate that.
How to Request Backdated Relief
The process is the same as a standard care leaver discount application, but you need to make the backdating request explicit. Include the following in your application:
- The date you first moved into the property and became liable for council tax
- The date you first met the age and care-history criteria in your council's policy
- A statement requesting that relief be backdated to the policy's effective date or your occupation date
If you've already been granted the Section 13A discount going forward but didn't get it backdated at the time, submit a separate written request to the revenues team. Reference your existing discount, your original occupation date, and the council's policy effective date.
Getting Your Overpayments Back
When backdated relief is approved, the council recalculates your account from the backdating start date. Every payment you made during that period that you shouldn't have owed becomes a credit on your account.
The council should either apply the credit to any outstanding balance or issue a refund directly. If there's no outstanding balance and the council doesn't refund automatically, write to the revenues team requesting a cash refund of the overpayment. Some councils process this within weeks; others need chasing.
Keep records of every payment you've made — bank statements showing direct debit payments or receipt records for cash payments at the council office. If the council disputes the amount, your payment records are your evidence.

When the Council Refuses to Backdate
Some councils grant the discount from the date of application only, refusing to backdate. Whether this is lawful depends on the policy wording. If the policy explicitly states relief is awarded from the occupation date or the policy effective date, and the council is refusing to honour that, you have grounds for an internal review followed by a Valuation Tribunal appeal.
If the policy genuinely limits awards to the application date forward, backdating isn't available under the class policy. Your alternative is an individual Section 13A(1)(c) hardship application for the historical period — arguing that you qualified during those months but didn't know the discount existed or were failed by administrative delays.
Administrative failures are common in care leaver cases. If your PA didn't inform you of the discount, or if the council's own website didn't mention the policy, these facts strengthen a backdating request. Document the failure and include it in your application.
Backdating and Arrears
If you've built up council tax arrears during the period that should have been covered by the discount, backdated relief should wipe them out. Once the council recalculates your account, any arrears that fall within the backdated period should be zeroed.
If you've already entered into a payment arrangement for those arrears, the council should cancel it and refund any payments made. If enforcement action has already been taken (a court summons or liability order), the recalculated account should reverse those actions — but you may need to push for this. Courts and bailiffs don't automatically know your account has been recalculated.
The Care Leaver Council Tax Claim System walks through the backdating application step by step, including the calculation worksheet to verify the council's recalculated figures and the template for requesting a refund of overpayments.
