How to Appeal a Council Tax Reduction Decision in BCP

Step 1: Request a Reconsideration

If you think BCP Council got your Council Tax Reduction wrong — refused your claim, miscalculated your award, or applied the wrong rules — your first step is a formal written reconsideration request.

You have one calendar month from the date on the decision notice to submit this. Send it to [email protected] or post it to Revenues and Benefits Services, BCP Council Civic Centre, Bourne Avenue, Bournemouth BH2 6DY.

Your reconsideration must state specific grounds. Vague complaints will not move the process forward. Common grounds include:

  • Income disregards that were not applied (PIP, DLA, and Child Benefit should be fully ignored)
  • Incorrect capital assessment (savings wrongly counted or tariff income miscalculated)
  • Non-dependant deductions applied when they should have been waived (you receive PIP daily living, DLA care at middle/highest rate, or Attendance Allowance)
  • Protected group status not recognised despite receiving a qualifying benefit
  • Band C cap applied when the household qualifies as protected

On receipt, BCP Council must refer your case to a different benefits assessment officer — someone who was not involved in the original decision. This is a legal requirement, not optional.

Step 2: Escalate to the Valuation Tribunal

If BCP Council maintains its decision after reconsideration, or if the council fails to respond within two months, you acquire a statutory right to appeal to the Valuation Tribunal for England (VTE).

The filing window is two months from either: the date of the council's reconsideration response, or the date the council's two-month response window expired (whichever applies).

The VTE is an independent tribunal. It has the power to determine whether BCP Council correctly applied its own scheme rules to your facts — whether the income calculation was right, whether the correct band was used, whether premiums and disregards were properly counted.

One important limitation: the VTE cannot challenge the policy design of BCP's scheme itself. It cannot, for example, rule that the 20% minimum contribution or the Band C cap is unfair. Structural challenges to the scheme require judicial review in the High Court, which is a different (and expensive) process.

Keep Paying While You Appeal

Lodging a reconsideration or a VTE appeal does not suspend your council tax bill. You must continue paying the instalments shown on your most recent Demand Notice until the tribunal issues a binding determination. If the appeal succeeds, the overpaid amount is credited back to your account.

Ignoring the bill while waiting for a ruling risks enforcement action.

What the VTE Can Actually Do

If the VTE agrees that BCP Council misapplied its scheme, it can order the council to recalculate your award. Common outcomes include:

  • Correcting the applicable amount to include missed premiums
  • Removing non-dependant deductions that should have been waived
  • Recognising protected group status and removing the 80% cap and Band C restriction
  • Backdating an award that was wrongly refused

The tribunal's decision is binding on BCP Council. Either side may appeal the VTE's decision to the High Court, but only on a point of law.

Prepare Your Case

Gather every document: the original decision notice, your reconsideration letter, the council's response (if any), your evidence of income and circumstances, and any correspondence with the benefits team. The tribunal considers evidence from both sides before making its decision.

The BCP Council Tax Reduction guide walks through the appeal timeline with exact deadlines and includes a council call prep sheet for when you need to discuss your case with the benefits team before formalising anything.
