WA Rates Hardship Help for Low-Income Property Owners

You Do Not Have to Be in Arrears to Ask for Help

If your council rates are becoming unmanageable, the worst thing you can do is ignore the notices and let penalty interest accumulate. Every local council in Western Australia maintains a formal Financial Hardship Policy, and you can apply for assistance before you fall behind — you do not need to be in debt to qualify.

Under section 6.47 of the Local Government Act 1995, a council may resolve by absolute majority to waive a rate or service charge, or grant a discretionary concession. For hardship cases, councils assess applications under their own policies and may offer interest waivers, flexible payment plans, or temporary freezes on legal recovery. The assessment is based on evidence of income disruption, illness, or circumstances affecting your capacity to meet basic living costs.

Council Hardship Provisions

When you contact your council's rates team and explain your financial situation, the typical provisions available include:

  • Tailored payment plans — interest-free instalment arrangements based on your income cycle, not the council's standard quarterly schedule
  • Interest charge waivers — suspension of penalty interest that would otherwise accrue on overdue amounts (up to 11% on unpaid Emergency Services Levy balances in some shires)
  • Legal recovery freeze — temporary freeze on legal debt recovery actions
  • Administrative fee write-offs — discretionary waiver of late payment and instalment administration fees

Each council sets its own eligibility criteria, but the common thread is genuine hardship — not simply preferring to pay later. You will typically need to provide evidence of your income situation.

When Concessions and Hardship Overlap

If you hold a qualifying concession card (Pensioner Concession Card, State Concession Card, or WA Seniors Card), your rates concession reduces the amount owed before any hardship arrangement kicks in. Council hardship provisions apply to the remaining balance — the amount after the state-funded rebate has been deducted.

If you do not hold any qualifying card, council hardship provisions are your primary form of relief. Contact your council directly to discuss what is available.

The WA Rates Concessions Guide covers both the state concession scheme and local council hardship options, including how to prepare a hardship application and what documentation strengthens your case.
