Somerset Council Tax Reduction and Universal Credit: What You Need to Know

When you apply for Universal Credit, there's a tick-box asking if you want help with council tax. Most people assume ticking it means they've applied for Council Tax Reduction. In Somerset, that assumption can cost you hundreds of pounds a year.

The Auto-Claim Myth

Ticking the council tax box on your UC application doesn't create a Council Tax Reduction claim. All it does is prompt the DWP to send an automated notification — a "UC Data Hub" alert — to Somerset Council, telling them you've claimed Universal Credit. That's it.

Somerset Council requires a completely separate application through its own online portal. If you don't complete that second application, you'll get no council tax discount, no matter what your UC journal says, and remain liable for the full bill.

How UC Income Is Assessed Under Somerset's Scheme

Somerset's working-age CTR scheme assesses your household's total weekly income and places you into one of four discount bands (100%, 50%, 25%, or 10%). When you're on Universal Credit, the assessment works like this:

  1. Your UC Housing Element is fully ignored — it doesn't count toward your assessable income at all
  2. Child Benefit and Child Maintenance are fully ignored
  3. PIP, DLA, Carer's Allowance, and Attendance Allowance are fully ignored
  4. Your UC standard allowance and child elements do count — these are assessed as income
  5. If you work alongside UC, the £25/week earnings disregard applies to your earned income

So your assessable weekly income is roughly your UC standard allowance plus child elements, plus any net earnings minus the £25 disregard, minus any disability disregard if applicable.

The Managed Migration Problem

If you've been moved from a legacy benefit (Income Support, income-based JSA, or income-related ESA) to Universal Credit through managed migration, pay close attention. Under legacy benefits, you likely received passported status — automatic Band 1, 100% discount, no income assessment needed.

Once you're on Universal Credit, that passported status disappears. Somerset Council reassesses your income under the banded scheme, and many people who had 100% CTR find themselves in Band 2 (50%), Band 3 (25%), or even Band 4 (10%). The council's scheme treats UC disability elements (the Limited Capability for Work and Limited Capability for Work-Related Activity components) as countable income rather than disregarding them the way legacy disability benefits were treated.

This specific issue — disabled residents losing CTR support after UC migration despite no change in actual financial circumstances — is the subject of an ongoing High Court judicial review against Somerset Council, brought by Leigh Day solicitors on behalf of a disabled Somerset resident.

What to Do When You Move to UC

The moment you receive your UC migration notice:

  1. Apply for Council Tax Reduction immediately through Somerset Council's portal at somerset.gov.uk — don't wait for the UC award to settle
  2. Request backdating if your UC claim started before your CTR application — Somerset allows up to 3 months of backdating with good cause
  3. Check your assessable income carefully against Somerset's income bands for your household size — the thresholds were uprated by 3.8% for 2026/27
  4. Report the change to Somerset Council within 21 days if your UC award changes, even if you are unsure whether it moves you between bands

If the transition has left you unable to pay your council tax bill, apply for the Somerset Exceptional Hardship Scheme — a separate discretionary fund that can top up your award.

Our Somerset Council Tax Reduction guide includes a worked UC income calculation showing exactly which elements are counted and which are disregarded, plus a backdating request template if you missed the claim window after migration.
