Kirklees Council Tax Arrears: What to Do If You've Fallen Behind

Don't Ignore It

Council tax arrears escalate faster than most debts. Kirklees Council follows a set enforcement process, and later stages can add costs and reduce your options. The sooner you act, the more options you have.

Here's what the timeline looks like if you don't pay:

  1. Reminder notice — after a missed instalment; if you do not bring the account up to date within 7 days, the full year's charge can become due. Kirklees may issue up to three reminders in a financial year.
  2. Final notice — after a third missed instalment, Kirklees may require the full remaining annual charge within 7 days
  3. Court summons — Kirklees applies to the Magistrates' Court for a liability order; its current recovery policy lists a £102.50 summons cost
  4. Liability order — the court grants the council legal powers to recover the money through earnings deductions, benefit deductions, or bailiff action

Once a liability order is granted, the council can instruct bailiffs (enforcement agents), apply to deduct from your wages or benefits, or in extreme cases seek a charging order on your property.

Step 1: Claim What You're Owed

If you're on a low income and haven't claimed Council Tax Reduction, do it now. CTR can reduce your bill by up to 75% for working-age residents. If you're already getting CTR, check that the council has your current circumstances — a change you didn't report could mean you're entitled to more.

Applying for CTR won't clear existing arrears, but it reduces the ongoing charge and prevents the debt from growing.

Step 2: Contact the Council About a Payment Plan

Use Kirklees Council's online payment-arrangement form to ask for a plan. If you've received a final notice, call 01484 414959. Be prepared to explain your financial situation — income, outgoings, and other debts.

An arrangement requested through the online form must finish by 31 March. The council will review your request and send you a letter showing any new payment plan.

Step 3: Get Free Debt Advice

If you have multiple debts or can't afford any payment arrangement, contact a free debt advice service before agreeing to anything:

  • StepChange — 0800 138 1111, free debt management plans and budgeting advice
  • National Debtline — 0808 808 4000, independent debt advice including council tax arrears
  • Citizens Advice Kirklees & Law Centre — use the online contact form at kcalc.org.uk/contact-us for benefits and debt advice; its former advice-line number is no longer answered

These services can negotiate with the council on your behalf and may recommend formal debt solutions.

Breathing Space

If you're getting debt advice, your adviser can apply for Breathing Space — temporary protection that can last up to 60 days. For debts included in the scheme, enforcement action cannot be taken and creditors cannot add interest or charges. You still need to make your debt repayments.

There's also a Mental Health Crisis Breathing Space for people receiving NHS crisis treatment, which lasts the duration of treatment plus 30 days.

Breathing Space doesn't clear the debt, but it stops the situation getting worse while you get advice.

What Not to Do

  • Don't ignore letters — each stage removes options and adds costs
  • Don't pay other debts first — council tax is a priority debt under debt advice rules; it should be paid before credit cards, loans, or catalogue debts
  • Don't let enforcement agents in if you do not want them to enter — they cannot force entry to collect council tax on an initial visit. If you've let them in before or agreed a controlled-goods arrangement, different rules apply; speak to a debt adviser first

Prevent Future Arrears

Our Kirklees Council Tax Reduction guide helps you claim every reduction and discount you're entitled to, so your ongoing bill is as low as possible. The guide doesn't provide debt advice — that's what StepChange and Citizens Advice are for — but it ensures you're not paying more council tax than you need to.
