Holiday Let Council Tax or Business Rates: The 140/70 Rule in England
Why Holiday Let Owners Want Business Rates
A furnished holiday property that sits on the council tax list as a second home faces the 100% Section 11C premium — doubling the annual bill. Moving the property to the Non-Domestic Rating (business rates) list removes it from council tax entirely. Better still, many holiday lets qualify for Small Business Rate Relief, which can reduce the business rates bill to zero.
That combination — escape the premium and potentially pay nothing — has driven a wave of applications since the premium went live in April 2025. But the route is not automatic, and the thresholds are strict.
The Three Statutory Tests
To qualify as self-catering holiday accommodation in England, a property must satisfy all three of these requirements, verified by the Valuation Office Agency (VOA):
Prior commercial availability: at least 140 nights. In the preceding 12 months, the property must have been available for commercial letting for at least 140 nights. Evidence includes booking portal calendars showing available dates and public advertisements.
Prior actual letting: at least 70 nights. In the same 12-month period, the property must have actually been let to paying guests for at least 70 nights. Guest receipts, booking platform records, letting ledgers, and bank deposits serve as evidence.
Future commercial availability: at least 140 nights. In the coming 12 months, the property must be available for commercial letting for at least 140 nights. Marketing contracts and forward booking schedules support this.
These thresholds are England-specific. Wales requires 182 nights of availability and higher letting thresholds. Scotland has its own separate regime. Do not apply Welsh or Scottish rules to an English property.
How the Transfer Works
The process goes through the VOA, not your council. Your billing authority cannot reclassify the property — only the VOA decides whether it moves to business rates.
You submit VOA Form VO 6048 (Self-Catering Accommodation Questionnaire), along with your letting ledgers, advertising portal links, guest receipts, and booking calendars. The VOA assesses whether the 140/70 thresholds are met and, if so, transfers the property from the Council Tax Valuation List to the Non-Domestic Rating List.
Once transferred, council tax liability ceases and business rates apply instead. If the rateable value is £12,000 or less and it is the only property your business uses, 100% Small Business Rate Relief can reduce the business rates bill to zero.

What Happens If You Fail the Thresholds
The VOA reviews letting records on a rolling 12-month basis. If your property fails to achieve 70 nights of actual letting in any rolling period, the VOA can transfer it back to the Council Tax list. At that point, the second home premium applies retrospectively — and you may owe backdated premium charges from the date the property ceased to qualify.
This is not theoretical. Cornwall Council and others actively cross-reference holiday-let registers with business rates entries, and the VOA has increased scrutiny since the premium went live.
Not an Exception — an Alternative Regime
The holiday-let business rates route is not one of the second-home premium exceptions under SI 2024/1007; it is a completely separate tax regime. Properties with a planning restriction that prevents occupation for 28 or more consecutive days in a year may also qualify for the Class L exception, which is a different mechanism that blocks the premium without leaving the council tax list.
