Council Tax Reduction Overpayment and Arrears in Wales
Finding out you owe council tax you thought was covered is stressful. Excess Council Tax Reduction is adjusted on your council tax account, and free debt advice services can help if this leaves you with arrears.
How CTR Overpayments Happen
An overpayment occurs when the council paid more CTR than you were entitled to. Common causes:
- Unreported income changes — you started work, got a pay rise, or your UC award changed, and the council did not know
- Delayed reporting — you reported the change, but the council took weeks to process it, during which time you received the old (higher) CTR
- Incorrect information on your application — savings or income figures that turned out to be wrong
- Council error — the council miscalculated your applicable amount, missed a non-dependant deduction, or applied the wrong taper
When excess CTR is identified, the council may reverse the excess credit on your council tax account, changing the balance and future instalments. If it resulted from official error and you could not reasonably have been expected to realise the mistake, the excess CTR is legally non-recoverable.
Can You Challenge an Overpayment?
Yes. If you believe the overpayment is wrong — because the council's recalculation used incorrect figures, or you reported the change earlier than they acknowledge — request a formal written review.
If the excess resulted from official error and you could not reasonably have been expected to realise the mistake, ask the council to review the decision because the amount is legally non-recoverable.
The overpayment notice should explain how the figure was calculated. If it does not, ask for a full breakdown before you accept the amount.

Discretionary Reduction for Hardship
If you are in genuine financial hardship and council tax arrears are piling up, your council has discretionary power under Section 13A(1)(c) of the Local Government Finance Act 1992 to reduce or write off council tax that would cause exceptional hardship.
This is not an entitlement — it is entirely at the council's discretion. But if your income is so low that even with CTR you cannot afford the remaining bill, applying for a Section 13A discretionary reduction is worth trying. Provide full details of your income, expenses, and debts, and explain why paying the council tax would cause hardship beyond what CTR already addresses.
Preventing Future Overpayments
The simplest prevention: report changes promptly. If your income rises, a non-dependant moves in, or your UC award changes, tell the council immediately. The longer the gap between the change and the report, the larger the overpayment accumulates.
Keep records of what you reported and when. If the council claims you did not report a change, your records are your defence.
The Council Tax Reduction in Wales guide includes a change-of-circumstances report template and a claim tracking log for documenting every interaction with the council — evidence that protects you if overpayment recovery is disputed.
