Council Rates Hardship Relief in South Australia: Section 182 Explained

What Section 182 Hardship Relief Is

Section 182 of the Local Government Act 1999 gives your council discretionary power to remit (permanently waive) or postpone rates, in whole or in part, where you can demonstrate severe financial hardship or extenuating circumstances.

Unlike the Seniors Rates Postponement under Section 182A, this is not an automatic entitlement. Your council decides. Each of SA's 68 councils maintains its own hardship policy with its own criteria and processes.

What Councils Typically Offer

Most council hardship policies provide a combination of:

  • Late payment fine waivers — removing the statutory 2% late payment penalty
  • Interest freezes — stopping monthly penalty interest from accruing on overdue balances
  • Flexible payment plans — weekly or fortnightly instalments instead of quarterly lump sums
  • Debt collection holds — pausing formal legal recovery while you work through a plan
  • Discretionary postponement — deferring some or all rates for a set period

Full principal remission — permanently writing off the rate debt — is rare. Councils reserve it for catastrophic hardship and almost always require documented evidence of extreme circumstances.

What Councils Require Before They Will Help

Most councils require you to have already claimed all available state concessions before they consider hardship relief. That means:

  1. Applied for the Cost of Living Concession through ConcessionsSA
  2. Applied for water and sewerage concessions
  3. Applied for the ESL remission

If you have not claimed these, the council will typically send you back to ConcessionsSA first. State concessions are the baseline; council hardship relief is the secondary safety net.

Several councils — including Onkaparinga and Playford — also require you to undertake free, accredited financial counselling before they will grant partial remissions. This is both a support mechanism and a verification step.

How Different Councils Handle It

Council hardship policies vary significantly:

City of Adelaide: Waives late payment fines and interest on approved hardship applications. Offers custom payment plans and discretionary postponement under Section 182. Also maintains a separate discretionary $100 pensioner rate rebate for eligible Pensioner Concession Card holders who qualify for the State Cost of Living Concession.

City of Onkaparinga: Formal Financial Hardship Policy (Rates) running 2024–2029. Holds debt collection, waives late fines, and structures tailored repayment plans. Refers ratepayers in debt to accredited financial counsellors.

City of Salisbury: Freezes interest penalties and structures tailored repayment schedules. Section 182 postponement available upon financial counsellor assessment. Residential rate capping limits for owner-occupiers.

Rural City of Murray Bridge: Flexible payment plans and interest waivers. Section 182 postponement available for primary producers and residents experiencing hardship.

How to Apply

Contact your council's rates department directly. Most councils accept hardship applications:

  • In writing (letter or email to the rates team)
  • Through the council's online customer service portal
  • In person at the council office

You will need to explain your financial circumstances and provide supporting evidence — typically income statements, bank records, and details of existing debts. Some councils have a specific hardship application form; others accept a written statement.

When You Need More Than a Payment Plan

If you are behind on rates by two or more years, facing a legal demand letter, or at risk of a forced land sale under Section 184, a council payment plan may not be enough. Contact the National Debt Helpline on 1800 007 007 for free, confidential financial counselling. An accredited counsellor has statutory standing to negotiate directly with your council and can halt enforcement proceedings while they work through your situation.
