Bradford Council Tax Reduction Overpayment: What Happens and How to Dispute It

An overpayment letter from Bradford Council's revenues team is one of the most alarming things a CTR claimant can receive. Officially called an "excess reduction," it means the council awarded you more CTR than you were entitled to for a past period — and they are adding the difference back to your council tax bill.

How Overpayments Happen

The most common triggers are late reporting of a change in circumstances. Under the scheme regulations, you must notify Bradford Council within 21 days of any material change:

  • Your income increased (new job, extra hours, partner started working)
  • Your Universal Credit award changed
  • Your savings crossed relevant thresholds
  • A non-dependant moved in or their income changed
  • Your household composition changed (partner moved in, child turned 18)

If the council finds out about a change after the fact — often through the UC automated data feed — they retroactively recalculate your CTR from the date the change actually happened. The difference between what you received and what you should have received becomes the excess reduction.

The second common cause is UC income fluctuation. When a high-earning month flows through ATLAS and reduces your UC, the council may recalculate your CTR for that month. If your CTR for the period was already applied to your bill at the higher rate, the adjustment creates an overpayment.

How Recovery Works

Bradford Council does not chase CTR overpayments separately — they reverse the reduction on your council tax account. The overpaid CTR is added back to your annual council tax liability, and the council issues a revised demand notice showing the higher balance.

This revised notice recalculates your remaining instalments. If most of the year's payments are still ahead of you, the increase may be spread thinly. If the overpayment is discovered late in the year, the revised instalments can jump sharply.

If you cannot afford the revised instalments, contact Bradford Council's Revenues and Benefits Service (01274 432772) immediately. If the revised bill is not paid according to its instalment schedule, standard council tax collection enforcement can follow.

When to Dispute

You should dispute an overpayment if:

  • The underlying CTR calculation is wrong — the council used incorrect income figures, missed a disregard, or applied the wrong non-dependant deduction tier
  • The change date is wrong — the council backdated the recalculation further than the actual date of the change
  • You did report the change on time — if you notified the council within 21 days, include proof of that notification in your request. Reporting on time does not by itself show that the recalculation is wrong.

Submit a written revision request to [email protected] stating the specific error and attaching evidence (your UC statements for the period, payslips, or the original change notification if you have a copy). The council has two months to respond.

If the revision is rejected or ignored, you can appeal to the Valuation Tribunal for England. The appeal is free and the VTE can review whether the overpayment calculation was correct.

What You Cannot Dispute

Spending money already paid does not by itself show that the overpayment calculation is wrong. If you cannot afford the revised bill, you can:

  • Request an affordable repayment arrangement
  • Ask about Bradford Council's Council Tax Reduction Discretionary Support Scheme if you already receive CTR and face exceptional short-term hardship; this scheme is separate from the Section 13A(1)(c) discretionary power
  • Seek free debt advice from Citizens Advice Bradford & Airedale (08082 787 828), StepChange (0800 138 1111), or National Debtline (0808 808 4000)

Prevent Overpayments

The best defence is reporting changes promptly. Whenever your income, UC award, or household composition changes, notify Bradford Council in writing within 21 days — do not rely on the DWP's automated feed, because telling the DWP does not legally satisfy your obligation to inform the council separately.

The Bradford Council Tax Reduction Claim Toolkit includes a change-of-circumstances log that helps you track what you reported, when, and through which channel — documentation that protects you if the council claims you reported late.
