Birmingham Council Tax When Your Partner Dies: New Claims, Discounts and Deadlines

What Changes Immediately

When your partner dies, your council tax situation shifts in several ways at once. Your household composition changes, your income changes, and your existing CTS claim — if you had one — needs reassessing. The council treats the death as a change of circumstances, and the clock starts from the date of death.

If council tax was in your partner's name, tell Birmingham City Council so it can update the account and confirm who is liable after the death. If it was in joint names, ask the council to update the account for the surviving liable person.

The One-Month Window for a New CTS Claim

If your partner was the CTS claimant and you weren't, their claim ends on the date of death. You have one month from that date to submit your own new claim. If you claim within that month, the council can pay your award from the date your partner died.

Miss the one-month window and you'll need to demonstrate "good cause" for the delay to get any backdating at all, and even then Birmingham only backdates working-age claims by a maximum of one month.

Given everything else happening during bereavement, this deadline is easy to miss. Birmingham says you need to make an online claim within the month. If you need help completing it, contact the Benefits Service; do not rely on registering an intention to claim alone to protect the claim date.

The Single Person Discount

Once you're the only adult in the property, you qualify for a 25% single person discount. This applies from the date your partner died — not from when you report it, though you do need to tell the council.

For 2026/27, the single person discount on a Band D property saves £588.29 per year. On Band A (the most common band in Birmingham), it's £392.20.

The discount is applied before your CTS is calculated, so it reduces the base figure the means test works from. Claiming both the discount and CTS together maximises the benefit.

How Your CTS Award Changes

If you were already claiming CTS jointly, the council reassesses your claim as a single-person household. This can go either way:

Your award might increase. Your partner's income is no longer counted. If they were working, the means test now looks at your income alone, which is likely lower. Your applicable amount changes too, but the income drop usually outweighs it.

Your protected status might change. If your partner's disability or carer status was what put your household in a protected category (100% award track), check whether you still qualify in your own right. Losing protected status drops you to the standard 80% maximum.

Non-dependant deductions might change. If other adults live in the property, their deduction status doesn't change because of a death — but your overall award recalculation might produce a different net figure.

Bereavement Benefits and Council Tax

If you qualify for Bereavement Support Payment (a lump sum plus up to 18 monthly payments), this is disregarded as capital for CTS purposes during the first 52 weeks. It won't push you over the £16,000 savings limit during that period.

Widowed Parent's Allowance (for deaths before April 2017) counts as income for the means test.

The Broader Picture

Council tax is one piece of a much larger administrative burden after a death — notifying banks, DWP, HMRC, the Land Registry, insurance companies. For the council tax specifics in Birmingham, the Birmingham Council Tax Reduction guide walks through the reporting and reclaim process step by step.

For the wider bereavement administration — probate, benefit changes, account notifications — bereavementstartguide.com publishes a separate guide specifically for that.
